2004 - Resolution - Exemption to the Five-Dwelling Unit Limitation to Caseco LaneRESOLUTION NO. 2004 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, ALLOWING AN EXEMPTION TO THE FIVE-DWELLING UNIT LIMITATION TO CASECO LANE. WHEREAS, the City of Port Orchard has adopted Private Road standards in Resolution 1971 in which private roads are limited to serving 5-dwelling units and can only be used in short plats, unless an exemption is specifically approved by the City Council; and WHEREAS, Caseco Lane is a private road constructed by Mr. Dan Case and it serves Short Plats S-1054, S-1069, and S-1099 with revisions, which were developed by Mr. Dan Case; and WHEREAS, Short Plats S-1054, S-1069, and S-1099 plus revisions were successive short plats of the same property completed after every five years as allowed by the City of Port Orchard; and WHEREAS, the original property consisted of two lots which totaled 13 acres now consist of 12 lots; and WHEREAS, Short Plat 1123 has divided the last large residential lot for a total of 12 home sites and 3 sloped area lots in the original 13 acre property and cannot be approved unless these three new lots access Caseco Lane, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: 1. The five-dwelling unit limit for private roads was adopted during the successive short plat process, and the City Council considers Short Plat S-1123 grandfathered for access to Caseco Lane. 2. Short Plat S-1123 is exempted from the 5-dwelling unit limitation established by Resolution 1971. 3. This exemption does not provide for any further new lot access from the original two lots first short plated by S-1 054 and S-1 069.
