A RESOLUTION OF THE CITY OF PORT ORCHARD, KITSAP COUNTY,
WASHINGTON, AMENDING THE CITY OF PORT ORCHARD PLANNING
AND DEVELOPMENT PROCEDURES REGARDING SITE PLAN
SPECIFIC REZONES.
WHEREAS, in 1998 the City Council adopted Planning and Development procedures by
Resolution No. 1844; and
WHEREAS, the City Council desires to amend the procedures regarding site specific
rezones, now, therefore
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE
THE FOLLOWING:
SECTION 1. Ordinance No. 1844, the City of Port Orchard Development Procedures
Title 2, Section 11 ( e )-(h) are amended to read as follows:
e: Unless otherwise stipulated, all zone adjustment actions are site plan
specific. Any major modification, deviation or departure from the originally approved
site plan or application shall require City Council review and approval of a modified
site plan after conducting a public hearing. The City Council may subject modified
site plans to new conditions. Removal of an -sp suffix designation shall require a
rezone in accordance with rezone procedures contained herein.
f: Time limits on planned residential developments, special use permits, and
conditional use permits are as follows:
1) planned residential developments - 3 years,
2) special use permits -180 calendar days,
3) conditional use permits-180 days.
If substantial progress toward construction of a preapproved site
plan or establishment of an approved use has not occurred at the
expiration of this time period, the council may revoke the zone
adjustment or approve a time extension commensurate with the
original time limit with conditions. An extension of said time limit
may be granted by the City Council only if the request is received
in writing prior to the expiration of the time limit for the applicable
zone adjustment.
g: If the time limit for a special use or conditional use has expired and no
timely extension request received, the permit shall be considered void. No notice
need be given nor hearing held.
After written notification by staff of an impending expiration date for
a planned residential development, the affected property owner
shall submit a written request for additional time. After 15 calendar
days, failure to submit this request will automatically nullify the
planned residential development.

h: Site plan specific rezones shall have no expiration period.
However, if substantial progress toward construction of a preapproved site
plan or establishment of an approved use has not occurred within five years
of the rezone, the City Council may subject the site plan to new conditions,
or may revoke the site plan specific rezone and cause the property to revert
to its prior classification.
