A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
CONFIRMING APPROVAL OF AN APPLICATION FOR EXEMPTION
FROM THE HEIGHT RESTRICTION IMPOSED BY THE VIEW
PROTECTION ORDINANCE (NO. 1785) AFFECTING THE SINGLE
FAMILY RESIDENCE LOCATED AT 1219 DOGWOOD HILL HOAD
WHEREAS, the City of Port Orchard adopted the View Protection regulations with the
understanding that there were some properties in the district which could be built upon in accordance to
the requirements of the zoning ordinance and not obstruct views of adjoining properties, and
WHEREAS, the applicant submitted a request for exemptions under the provisions of the
View Protection Guidelines and Requirements authorized by Ordinance 1785, and
WHEREAS, a public hearing was held on April 22, 2002 by the City Council to hear facts
and testimony concerning granting an exemption, and
WHEREAS, the City Council did determine that the granting of the exemption would not
be detrimental to the public health, safety, or welfare or create significant adverse effects to other
properties in the view protection overlay district, and
WHEREAS, after closing the public hearing the City Council did grant the exemption with
the condition that the project be "Site Specific", now therefore,
THE COUNCIL OF THE CITY OF PORT ORCHARD DOES RESOLVE AS FOLLOWS:
The City of Port Orchard grants an exemption from the View Protection Ordinance No.
1785 to Dave and Seanda Williams for the construction of a partial second story addition to a finished
height of 22 feet. The exemption is to the height restrictions of the regulations only, and limited to the
proposed project as described in VPE-714.00.01
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 13'h day of May 2002.
