A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
APPROVING THE ENCROACHMENT OF A COMMERCIAUMONUMENT SIGN
13 INCHES ONTO THE SEDGWICK ROAD RIGHT-OF-WAY-LOCATED AT 369
SEDGWICK ROAD. (Ron Rice, Applicant)
WHEREAS, Ron Rice, applicant, has submitted a request to allow a commercial/monument
sign to encroach 13 inches onto the Sedgwick Road right-of-way, located at 369 Sedgwick Road; and
WHEREAS, Ron Rice, applicant, conveyed that his objective of seeking authorization to
maintain the sign at this location is to alleviate traffic congestion; and
WHEREAS, based on the testimony and materials presented the City Council does hereby
conclude that maintaining the placement of the sign 13 inches onto the Sedgwick Road right-of-way as
presented, would not be detrimental to the health, safety, morals and general welfare of the community; and it
is in the best interest of the community to allow the sign as requested by Ron Rice, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
That the Council of the City of Port Orchard, Washington does hereby authorize the
encroachment of the Commercial/Monument sign (Exhibit "A") 13 inches upon city right-of-way, at 369
Sedgwick Road as requested by Ron Rice, with the following conditions:
1. The sign shall not adversely affect motorist's sight distance.
2. The sign shall be removed at the owner's expense when future road improvements or
other city improvements require it.
3. The owner shall provide a Certificate of Insurance listing the city as an additional insured
for any accidents or claims involving the sign. The insurance coverage shall be at least
coverage for $500,000 Bodily Injury and $500,000 Property Damage or $1 ,000,000
Combined Bodily Injury and Property Damage.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
