1919 - Resolution - Re-Adopting Res. No's 1880, 1878 and 1881 Declaring a Public EmergencyRESOLUTION NO. 1919 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, RE-ADOPTING RESOLUTIONS 1880, 1878 and 1881, DECLARING THIS A PUBLIC EMERGENCY AND EFFECTIVE IMMEDIATELY WHEREAS, the City of Port Orchard charges for certain services provided by the City and; WHEREAS, the City adopted Resolution 1880 on November 22, 1999 establishing fees for the use of City Hall facilities; and WHEREAS, the City adopted Resolution 1878 on November 22, 1999 establishing a fee for returned checks; and WHEREAS, the City adopted Resolution 1881 on November 22, 1999 establishing administrative fees for the Public Works Department; and WHEREAS, an Initiative of the State of Washington (1-722) intended to repeal any tax or fee increase enacted during the period that Resolutions 1880, 1878, and 1881 were passed by the City Council; and WHEREAS, the constitutionality of 1-722 has been challenged and will be subject to judicial review in early 2001; and WHEREAS, it is possible that the action of adopting these fees pursuant to Resolutions 1880, 1878, and 1881 may be nullified; and WHEREAS, it is the intent of the City of Port Orchard to ensure that fees continue to be collected at rates necessary to support City services without placing a burden upon the City's taxpayers who do not receive the services; now, therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON: SECTION 1. The fees previously adopted in Resolution 1880 (attached hereto as Exhibit A) are re-adopted by the City of Port Orchard. SECTION 2. The fee previously adopted in Resolution 1878 (attached hereto as Exhibit B) is re-adopted by the City of Port Orchard. SECTION 3. The fees previously adopted in Resolution 1881 (attached hereto as Exhibit C) are re-adopted by the City of Port Orchard. SECTION 4. The Staff is directed to charge said fees for the services set forth in Resolutions 1880, 1878, and 1881. Resolution No. 1919 Page 2 of2 SECTION 5. This action is deemed a public emergency and implementation shall occur immediately upon passage by a vote of a majority plus one of the Port Orchard City Council. WHEREAS, it is the desire of the City Council to provide fees for use of city hall facilities, WHEREAS, the City of Port Orchard has adopted Ordinance No. 1780 establishing procedures and policies for the use of city hall facilities, and authorizing fees established by city resolution, and WHEREAS, the City Council deems it in the best interest of the City of Port Orchard to periodically review and update such resolutions, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON HEREBY RESOLVES AS FOLLOWS: SECTION 1 Port Orchard City Hall Facilities Use Fees. The following fees are established for use of certain rooms within Port Orchard City Hall. Use of city hall faci!Hies are subject to policies and procedures as set forth in Port Orchard City Hall Facilities Use Policy adopted by Ordinance No. 1780. . A RESOLUTION OF THE CllY OF PORT ORCHARD, WASHINGTON ESTABLISHING A CHARGE FOR RETURNED CHECKS AND REPEALING RESOLUTION NOS.1486AND 1714 SECTION 1. Checks or Drafts tendered to the City and returned for any reason. (1) That there shall be assessed a charge of $30.00 for all drafts and checks tendered to the City which are returned or dishonored by the drawee bank or other such depository. (2) That said charge shall be collected from the draWer together with the proceeds of any such returned or dishonored instrument and said charge shall be oonsidered a part of the debt or deposit due the City for which it was tendered. (3) In the case of such penalty, the sum paid shall first be applied to the penalty. ( 4) In the event a drawer has two drafts and/or checks returned or dishonored in a one year period the City may exercise the right to refuse to accept drafts and/or checks until the. drawer can provide written proof from their bank or depository that they have not had any draft and/or check returned for a period of one year. Payments will be accepted in the form of cash, certified check or money order. SECTION 2, Payment in Lieu of Check. In the event a check has been returned by any bank, payment for said returned check shall be made in cash, certified check or money order. SECTION 3. Repealer. Resolution Nos. 1486 and 1714 are hereby repealed in their entirety. WHEREAS, the City of Port Orchard is responsible for implementing land use regulations, public works requirements, and other administrative duties, and WHEREAS, the City of Port Orchard has adopted Ordinance No. 1781 establishing fees for the Department of Public Works, and WHEREAS, there are costs associated with the implementation of city regulations and policies, and WHEREAS, the City Council deems it in the best interest of the City of Port Orchard to periodically review and update such resolutions, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON HEREBY RESOLVES AS FOLLOWS: 1. The fees that will be charged by the Public Works Department for the specified services are listed in Exhibit "A". 2. Fees not listed in Exhibit • N' will be determined by the City Council.
