AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING ORDINANCE NO. OO2-2L, ACCEPTING THE REVISED TERMS
AND CONDITIONS ASSOCIATED WITH THE FEDERALLY FUNDED
HTGHWAY SAFETY TMPROVEMENT PROGRAM (HStp) AS MANAGED By
THE WASHINGTON STATE DEPARTMENT OF TRANSPORTATION
(wsDoT) UNDER THETR 2O2O CtTy SAFETY GRANT PROGRAM,
APPROVING CONTRACT NO CO22.2I WITH WSDOT FOR THE CITYWIDE
STREET LIGHTING STUDY; PROVIDING FOR SEVERABILITY AND
PUBIICATION; AND SETTING AN EFFECTIVE DATE.
WHEREAS, on March 5,2020, the City's Public Works Department applied for Highway
Safety lmprovement Program (HSIP) grant funding through the Washington State Department
of Transportation (WSDOT) 2020 City Safety Program for a Citywide Street Lighting Study; and
WHEREAS, on December 23,2020, the City of Port Orchard Public Works Department
was notified by WSDOT that the Project was selected to receive $36K in federal funding
through the HSIP, with a 5+,000 local match requirement; and
WHEREAS, on February 9,202I, the Port Orchard City Council adopted Ordinance No.
OO2-27, thereby approving and authorizing the Mayor to execute Contract No. C022-21 with
the Washington State Department of Transportation; and
WHEREAS, on July I, 202I, the City received the Local Agency Agreement from the
Washington State Department of Transportation in the amount of 555,000 with no match
requiremen! and
WHEREAS, the City Council has determined it to be in the best interests of the City to
enter into Contract No. CO22-2L with WSDOT for the Citywide Street Lighting Study; now,
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. The City Council authorizes the Mayor to execute Contract No. C022-2L
with the Washington State Department of Transportation (WSDOT) for the Citywide Street
Lighting Study, inclusive of both the current WSDOT Project Administration Agreement
attached and the pending WSDOT Local Agency Agreement.
SECTION 2. Severabilitv. lf any section, sentence, clause or phrase of this Ordinance
should be held to be unconstitutional or unlawful by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other

section, sentence, clause or phrase of this Ordinance.
SECTION 3. Publication. This Ordinance shall be published by an approved summary
consisting of the title.
SECTION 4. Effective Date. This Ordinance shall take effect and be in full force and
effect five days after publication, as provided by law.
