A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
AUTHORIZING THE SALE AND CLEAN UP OF 514 BAY STREET.
WHEREAS, the City of Port Orchard owns the property at 514 Bay Street, and has used
it as a Public Works Shop, and
WHEREAS, the property at 514 Bay Street is not large enough to accommodate the
needs of the Public Works Department, and
WHEREAS, the City has agreed to sell the property to Harold H. Vlist and Shirley J. Vlist,
(husband and wife) subject to certain contingencies including issues relating to costs of contamination
cleanup, and
WHEREAS, the City has determined that there is petroleum contamination in the soil of
the property at 514 Bay Street, and
WHEREAS, the City recognizes that it has a responsibility by State and federal law to
remove the soil contamination, even though others may share responsibility for the costs of cleanup, and
WHEREAS, the City believes it to be in the best interest of the City to close the sale of
the property to Harold H. Vlist and Shirley J. Vlist, (husband and wife) in a timely manner, if Harold H.
Mist and Shirley J. Mist (husband and wife) are willing to do so and thereafter continue the cleanup of the
site holding Harold H. Vlist and Shirley J. Vlist (husband and wife) harmless, now therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE:
1. The City Council declares the land, buildings, air compressor, and vehicle lift at 514
Bay Street to be surplus to the needs of the City_
2. The Mayor is authorized to execute and deliver any and all documents reasonably
required and appropriate to close the sale of this property to Harold H. Vlist and
Shirley J. Vlist, (husband and wife) pursuant to the real estate purchase and sale
agreement previously entered into.
3. The Public Works section at 514 Bay Street will temporarily move to the Public Works
building at 2051 Sidney Avenue.
4. The City will assume its responsibility to clean up the soil contamination at 514 Bay
Street in order to relieve the new property owner of clean up requirements for pre-
existing conditions.
5. The Mayor is authorized to execute and deliver such documents and instruments to
complete the cleanup as may be reasonably required and appropriate to complete
the cleanup of the contaminated site (including contracts for such work) and as well
as an indemnificationlho[d harmless agreement with the new owner Harold H. Vlist
and Shirley J. Vlist (husband and wife) with respect thereto.
