A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
APPROVING INSTALLATION OF A SIGN ON THE PUBLIC RIGHT OF WAY —
LOCATED 1140 BETHEL AVENUE. (Sandy O'Donnell, applicant)
WHEREAS, Sandy O'Donnell, applicant, has submitted an application to install a
commercial/monument sign for property located at 1140 Bethel Avenue; and
WHEREAS, Sandy O'Donnell conveyed that their objective of seeking authorization to place
this sign at the requested location is to alleviate traffic congestion and safety concerns; and
WHEREAS, based on the testimony and materials presented the City Council does hereby
conclude that installation of the sign design and placement as presented would not be detrimental to the
health, safety, morals and general welfare of the community; and it is in the best interest of the community to
allow installation of the sign as requested by Sandy O'Donnell, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY
RESOLVES AS FOLLOWS:
That the Council of the City of Port Orchard, Washington does hereby authorize installation
of a Commercial/Monument sign for property located at 1140 Bethel Avenue as requested by Sandy
O'Donnell, with the following conditions:
(1) The sign shall not adversely affect motorists' sight distance.
(2) The sign shall be removed at the owner's expense when future road
improvements or other City improvements require it.
(3) The owner shall list the City as an additional insured for any accidents
or claims involving the sign. The insurance coverage shall be at least
$500,000 Bodily Injury and $500,000 Property Damage or $1,000,000
Combined Bodily Injury and Property Damage. A Certificate of
Insurance shall be submitted to the City Clerk prior to installation of the
sign.
(4) The agreement is only for the specific sign as shown in Exhibit A. Any
change or modification in the sign would have to have a new
agreement.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 12th day of April 1999 /
