A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT
ORCHARD ESTABLISHING THE NEIGHBORHOOD AROUND 900
MITCHELL AVENUE AS A TARGET AREA FOR THE DEVELOPMENT
OF AFFORDABLE HOUSING AND WAIVING LAND USE DENSITY
REQUIREMENTS.
WHEREAS, the City of Port Orchard is an established urban area which has higher
urban land use densities; and
WHEREAS, the City of Port Orchard is a community with many low and moderate
income families; and
WHEREAS, by targeting specific neighborhoods for the development of affordable
housing, the City will improve funding opportunities for families and individuals with incomes less than
80% of the Area Median Gross Income; and
WHEREAS, the City and Kitsap County Consolidated Housing Authority are seeking to
construct affordable housing for low and moderately low income senior citizens; and
WHEREAS, RCW 35.83 will allow the City to make exceptions to land use density
requirements when those exceptions are necessary in the public interest; now therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON HEREBY
RESOLVES AS FOLLOWS:
(1) The 2.17 acres at 900 Mitchell Avenue is hereby designated as a target area for
the development of affordable housing to serve families and individuals with incomes at 80% or less of
the Area Median Gross Income.
(2) Pursuant to RCW 35.83, the City of Port Orchard shall allow a maximum of two
42-unit apartment buildings to be constructed on the 2.17 acres located at 900 Mitchell Avenue. If this
property were short platted, this designation would remain with both parcels. The following is applicable:
(a) The modification of land use density for the Kitsap
Consolidated Housing Authority is considered a public use
and purpose in order to allow affordable housing for eligible
senior citizens.
(b) The apartment project will be funded with public funds and
will serve an essential governmental function by providing
much needed housing.
(c) It is in the public interest to allow Kitsap County
Consolidated Housing Authority to construct and provide this
essential housing.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor and
attested by the Clerk in authentication of such passage this 121h day of Peril 1999.
