1810 - Resolution - Policy for Repair and Maintenance of SidewalksRESOLUTION NO. 1810 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT ORCHARD ESTABLISHING A POLICY FOR THE REPAIR AND MAINTENANCE OF SIDEWALKS WHEREAS, the City of Port Orchard is responsible for the maintenance and repair of sidewalks; and WHEREAS, the Municipal Code establishes a responsibility of the abutting property owner for the repair and maintenance of sidewalks; and WHEREAS, the Public Works Department shall have a written policy on sidewalk repair, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE THE FOLLOWING: Sidewalks within the public right of way shall be repaired based upon the following criteria: (1) When the Public Works Department received a complaint or notice of claim about a sidewalk, a City employee will visit the site to determine if corrective action is needed: (a) If the sidewalk is damaged and it appears that the damage was caused by the City, the Public Works Department will repair the sidewalk. (b) If the sidewalk is damaged and it appears that the damage was caused by the abutting property owner, the City will order the abutting property owner to repair the sidewalk, in accordance with the Municipal Code. (c) If the sidewalk is damaged and there is no obvious reason for the cause of the damage, the City will order the abutting property owner to repair the sidewalk, in accordance with the Municipal Code. (d) if the abatement order is not complied with, the Public Works Department will repair the sidewalk at the owner's expense. (2) The abutting property owner is responsible for keeping the sidewalk clear of snow, ice, or other hazards. Resolution No. 1810 Page Two of Two (3) Every other year, the Public Works Department will have the concrete sidewalks inspected to identify areas which will need repair. Public Works shall make a prioritized list of repairs. (4) Repairs of sidewalks are meant to reduce tripping hazards and can consist of replacement of the walkway, grinding to reduce the imperfection, beveling the potential tripping hazard with mortar or concrete, or other remedies as determined by the Public Works Department. (5) If repairs are not feasible for whatever reason, the area shall be marked in order to warn the average user of the existence of the defect.
