RESOLUTION NO. 1813
A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON PROVIDING A CONDITIONAL USE
PERMIT FOR CLIFF THOMPSON FOR A NEW
BULKHEAD AND APPROPRIATE BACK FILL
Tax Account No. 342401-2-007-2006
Legal Description: Section 34, Township 24, Range 1 East,
West 100 feet of Lot 2 excluding the road and tideland
frontage.
WHEREAS, the City annexed Ross Point in December 1997; and
WHEREAS, WAC 173-26-160 requires the City to use the Kitsap County Shoreline
Management Master Program until such time as the City's Shoreline Master Program is amended
to recognize the Ross Point area; and
WHEREAS, the applicant submitted a substantial development permit and
conditional use permit application on February 28, 1998 for shorelines review to construct a 140-
foot long bulkhead and back fill the area behind it with approximately 150 cubic yards of rock fill;
and
WHEREAS, the project referred to as the Cliff Thompson bulkhead and back fill has
received a Mitigated Determination of Non -Significance by Kitsap County in 1996 which remains
valid; and
WHEREAS, a Hydraulic Project Approval was granted for this project from the
Department of Fish and Wildlife in 1996 which remains valid; and
WHEREAS, a public hearing was held on June 8, 1998 by the City Council to hear
facts and testimony concerning granting a conditional use permit with regard to the Shoreline
Management Program; and
WHEREAS, the City Council has determined that the granting of a conditional use
permit is consistent with the intent of the Shoreline Management Program; now, therefore,

THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY
RESOLVE THE FOLLOWING:
The City of Port Orchard recommends approval to the Department of Ecology for
the granting of a conditional use permit to allow the construction of a 140-foot long timber bulkhead
with 150 cubic yards of rock back fill for Cliff Thompson with the following conditions:
1. Applicant agrees to remove the log floats, piling, miscellaneous planks and
the large steel mooring buoy from the beach.
2. Applicant agrees to leave all bank vegetation possible, except that which is
necessary to remove for construction and worker safety purposes.
3. Applicant agrees to shorten the overall length of the bulkhead to
approximately 140 feet (versus the original 175 feet) by eliminating
approximately 35 feet at the southwest end of the bulkhead; the southwest
end of the bulkhead shall end with a wing into the bank at an approximate
30-degree angle.
4. Applicant agrees to spread washed pea gravel at the foot of the new
bulkhead at the rate of 1 cubic yard of material for each fi lineal feet of
bulkhead.
5. Prior to commencement of work, a building permit shall have been issued
from the City of Port Orchard.
fi. Approval of this application does not include other alterations to the site.
These must be considered separately.
