A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
SETTING FORTH FACTS, FINDINGS AND CONCLUSIONS RELEVANT
TO THE RENEWAL OF A RESIDENTIAL SUBDIVISION MORATORIUM
WHEREAS, the City Council did declare a moratorium on all residential subdivisions on
March 25, 1996; and
WHEREAS, this moratorium was declared to allow the City to adopt zoning standards more
consistent with the adopted comprehensive plan; and
WHEREAS, this moratorium was expected to last only nine months in accordance with the
work plan to allow the drafting and adoption of these new zoning standards; and
WHEREAS, the Zoning Code Task Force did complete their draft of a new zoning code in
September 1996; and
WHEREAS, the Planning Commission did recommend approval of the rovised draft zoning
code in December 1996; and
WHEREAS, the City Council took testimony at 45 separate meetings on the draft zoning
code; and
WHEREAS, in accordance with RCW 35.63.200, moratoriums must be renewed after one
year and every six -months thereafter; and
WHEREAS, the City Council did hold a public hearing on September 14, 1998 to take
testimony, review materials and consider all information presented regarding the renewal of the existing
moratorium; and
WHEREAS, the staff expects to complete its revisions to the text shortly with State review
adding 60-days prior to final adoption of a new zoning code by the end of the year; and
WHEREAS, the City Council did decide on September 14, 1998, to renew the existing
residential subdivision moratorium until January 1, 1999, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE
A5 FOLLOWS:
THAT the City does renew the residential subdivision moratorium until January 1, 1999 with
the following facts and findings.
Fact: (1) The Zoning Code must be consistent with the adopted Comprehensive
Plan.
(2) Staff is making changes to the draft as determined by the City Council
during their 45 separate public meetings.

(3) No members of the public submitted written or verbal testimony at either the
City Council meeting in March 1997 or September 1997 concerning the
renewal of the moratorium.
Finding: (1) The draft Zoning Code is consistent with the adopted
Comprehensive Plan because it includes more flexible
development standards.
(2) A three and one half -month renewal of the residential subdivision
will not significantly affect development within the city.
Conclusion: Based on testimony, materials presented and findings of fact, the City
Council of the City of Port Orchard does hereby renew the residential
subdivision moratorium which will expire on January 1, 1999.
PASSED by the City Council of the City of Port Orchard, APPROVED.by the Mayor and
attested by the Clerk in authentication of such passage this 14th y of September, 1998.
