A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
FIXING THE DATE OF PUBLIC HEARING ON A PETITION TO VACATE
A PORTION OF ROCKWELL AVENUE.
THE COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE THAT:
A Public Hearing on a Petition to Vacate a portion of the undeveloped Rockwell Avenue
right-of-way (located adjacent to the Victorian Tea Room), further described as follows, is hereby fixed for
Monday, November 23, 1998 at 7:35 P.M. in the City Council Chambers, City Hall, 216 Prospect Street,
Port Orchard, Washington.
LEGAL DESCRIPTION: That portion of Rockwell Avenue in the Plat of Sweany
Second Addition to Sidney, as per plat recorded in Volume 2 of Plats, Page 18, Records of Kitsap County,
Washington, described as follows: Beginning at the southeast corner of Lot 22, Block 5, said Sweany's
Second Addition to Sidney, the true point of beginning; thence north 10 09' 24" east 13.56 feet along the
east line of said Lot 22; thence south 880 45' 14" east 30.00 feet to the east line of Section 35, Township
24 North, Range 1 East, W.M., in Kitsap County, Washington; thence south 10 09' 24" west 14.39 feet
along said Section line, thence north 870 12' 21" west along the south line of said Plat 30.01 feet to the
true point of beginning.
The aforesaid property is approximately thirty feet (30') wide and approximately thirteen
and ninety-seven hundreds feet (13.97') long containing approximately 419.10 square feet.
The Petitioner is the owner of an interest in real estate abutting on the above -described
area.
The Petitioner constitutes more than two-thirds of the owners of said portions of abutting
property.
WHEREFORE, Petitioner prays that proceedings be had hereon for the Vacation of said
area of said right-of-way in the manner prescribed by RCW 35.79.
PASSED by the City Council of the City of Port Orchard, GNED by the Mayor and
attested by the Clerk in authentication of such passage this 26th day of obey 1998.
