1772 - Resolution - Conditional Use Permit for Marine RailwayCity of Port Orchard 216 Prospect Street Port Orchard, WA 98366 3032209 v071311970 18R41A C1TY OF PORT ORCHARD RESOL Kitsap C RESOLUTION NO. 1772 ✓ A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON PROVIDING A CONDITIONAL USE PERMIT AND SUBSTANTIAL DEVELOPMENT PERMIT FOR THE PORT ORCHARD MARINE RAILWAY REPAIR AND EXPANSION. - WHEREAS, the City adopted the revised Shoreline Master Program in 1994 to regulate the property within the jurisdiction of that Program; and . WHEREAS, the project referred to as the Port Orchard Marine Railway has received a Mitigated Determination of Non -Significance; and WHEREAS, a public hearing was held on May 27, 1997 by the City Council to hear facts and testimony concerning granting a conditional use and substantial development permit with regard to the Shoreline Management Program; and WHEREAS, the City Council has determined that the granting of a conditional use and substantial development permit is consistent with the intent of the Shoreline Management Program, now, therefore, THE CITY OF PORT ORCHARD CITY COUNCIL DOES RESOLVE AS FOLLOWS: THAT the City of Port Orchard recommends approval to the Department of Ecology for the granting of a conditional use and substantial development permit to allow the repair and expansion of the Port Orchard Marine Railway with the following conditions: 1. Prior to commencement of work, the necessary permits from the City of Port Orchard and the Department of Fish and Wildlife shall have been issued. 2. The project shall comply with the City's Cross Connection policy and ordinance. Resolution No. 1772 Page Two of Two 3. As per the City's Shoreline Master Program, the applicant shall provide and maintain adequate pumpout, holding, and/or treatment facilities for sewage on boats and vessels. Such facilities shall be accessible to all marina users, be designated by highly visible signage, and be designated according to plans and specifications approved by the Bremerton-Kitsap County Health District. If overnight guest moorage is allowed, access to rest room facilities shall be provided. Such provision shall be demonstrated within building permit application plans. 4. Stormwater shall not be directed onto adjacent properties. 5. The applicant must address fire protection on the floats as required in Appendix 11 C of the Uniform Fire Code as part of the building permit process. 6. A revised parking plan must be submitted prior to building permit issuance demonstrating the required number of parking spaces, including handicap accessible spaces. Such parking facilities shall provide at a minimum one (1) vehicle space for every three (3) moorage spaces and for every four hundred (400) square feet of interior floor space devoted to accessory retail sales or service. Any joint parking arrangements must be made in writing. 7. Approval of this application does not include any alteration to existing buildings on site. 8. No dredging is allowed as part of this permit application.
