1784 - Resolution - Appeal of a VarianceCity of Port Orchard 216 Prospect Street Pori Orchard, WA 98366 RESOLUTION NO. 1784 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING AN APPEAL OF A VARIANCE TO INCREASE THE PERCENTAGE OF COMPACT PARKING SPACES, DECREASE THE WIDTH OF THE SIDE YARD PARKING LOT LANDSCAPE BUFFERS AND THE LENGTH OF THE REQUIRED PARKING SPACES FOR A PARKING LOT OF A PROPOSED 2-STORY PROFESSIONAL, OFFICE BUILDING AT 622 DWIGHT STREET. LEGAL DESCRIPTION: SEE ATTACHMENT "A" TAX ACCOUNT NUMBER 4650-005-008-0006 WHEREAS, the applicant requested a Variance to approve a retaining wall and fence on both side yards in lieu of the required five (5) foot side yard landscaping buffers, increase the amount of compact parking spaces from 20% to 40% and decrease the length of the parking spaces from 20 feet to 18 feet; and WHEREAS, a Public Hearing was held on Wednesday, July 21, 1997, and the Planning Commission considered at length the findings and facts of the proposal, testimony, and materials presented at the hearing and ultimately denied the variance. WHEREAS, Mr, M.E. Brown filed an appeal with the City Clerk on July 23, 1997: WHEREAS, a Public Hearing was held on Monday, August 11, 1997, concerning the appeal, and the City Council considered at length the findings and facts of the proposal, testimony, and materials presented at the Hearing; and WHEREAS, the variance would not set a precedent for future area developments, and WHEREAS, a substandard sized parking lot would not contribute to the existing traffic congestion around the Courthouse; and Resolution No. 1784 Page Two of Two WHEREAS, the proposed use will not be detrimental to the public health, safety, welfare and be injurious to property and improvements in the vacinity, and therefore is in conformance with the objectives of the Comprehensive Plan; and WHEREAS, the request for a variance is in conjunction with a request for a Special Use Permit, and WHEREAS, the applicants propose to demolish an existing single family residence and detached garage at 622 Dwight Street and construct a 3,960 square foot 2-story professional office building, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE: That the Variance is compatible with the surrounding land uses and not detrimental to the surrounding community. CONCLUSION: Based upon the facts, testimony, and materials presented at the Public Hearing, we therefore conclude that the Variance to increase the percentage of compact parking spaces, decrease the width of the side yard parking lot landscape buffers and the length of the required parking spaces for a parking lot of a proposed 2-story professional office building at 622 Dwight Street is in harmony with the general purposes of the Zoning Ordinance and Comprehensive Plan with the following 3 conditions: This variance does not apply to the disabled parking space which must be 20 feet in length. 2. A building permit is required prior to installation of the retaining wall and fence combination and the eight (8) foot tall front yard retaining wall. 3. The terms of this variance shall be implemented within 180 days or the variance shall be considered void. An extension of time may be considered and granted by the Planning Commission upon a written request by the applicant showing a demonstration of just cause.
