1786 - Resolution - Issuance of Special Use Permit to BuettgenbachCity of Port Orchard 3037079 216 Prospect Street page: t of 2 Port Orchard, WA 98366 08/28/97 09:51R CITY OF PORT 11RCHARLI RIr8i1L $9.60 Kitsap Ca, A RESOLUTION NO. 1786 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON APPROVING THE ISSUANCE OF A SPECIAL USE PERMIT TO PAUL BUETTGENBACH FOR PROPERTY LOCATED AT 250 BETHEL AVENUE FOR A SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS IN HARMONY WITH THE VARIOUS ELEMENTS OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS NOT DETRIMENTAL TO EXISTING USES PERMITTED IN THAT PARTICULAR ZONE, Tax Account No. 4062-004-003-0006 Legal Description: Section 25, Township 24, Range 1 East, Wheelers Addition to Sidney, Block 004, Lots 3 and 4 WHEREAS, the City Planning Commission has held the required public hearing in accordance with the criteria set forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and; WHEREAS, the City Planning Commission has recommended approval of the Special Use Permit application by Paul Buettgenbach to allow an open storage yard at 250 Bethel Avenue and has recorded with the City Clerk their decision setting forth their findings and recommendations, and WHEREAS, affected property owners may request a change in valuation for property tax purposes notwithstanding any program of revaluation, and WHEREAS, the City Council did hold a public hearing on August 11, 1997 to take testimony, review materials and consider all information presented, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE AS FOLLOWS: Adopt Planning Commission Resolution No. 280-97, with Findings, Facts and Conclusions as their own and does hereby approve the issuance of a Special Use Permit to allow for an open storage yard at 250 Bethel Avenue with the following 3 conditions: 3037079 Patine : 2 of 2 11111111111111111111 HIII 111111111111111111111111111 Jill 08/28/97 W 51A CITY OF PORT ORCHARD RESOL $9.00 Kitsap Co, WA Resolution No. 1786 Page Two of Two 1. The site obscuring fence shall be maintained at all times. 2. All impound vehicles shall be stored at all times in the impound yard and not in the public right of way for any period of time. 3. The terms of the Special Use Permit shall commence within 180 days from the effective date of approval. If the time limit for development expires and development has not commenced, or the use permitted by the does not exist, the permit shall be considered void. No notice need not be given nor hearing held.
