A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON SETTING FORTH FACTS, FINDINGS AND
CONCLUSIONS RELEVANT TO THE RENEWAL OF A SIX
MONTH RESIDENTIAL SUBDIVISION MORATORIUM.
WHEREAS, the City Council did declare a moratorium on all residential
subdivisions on March 25, 1996; and
WHEREAS, this moratorium was declared to allow the City to adopt zoning
standards more consistent with the adopted comprehensive plan; and
WHEREAS, this moratorium was expected to last only nine months in accordance
with the work plan to allow the drafting and adoption of these new zoning standards; and
WHEREAS, the Zoning Code Task Force did complete their draft of a new zoning
code in September 1996; and
WHEREAS, the Planning Commission did recommend approval of the revised draft
zoning code in December 1996; and
WHEREAS, the City Council is reviewing the draft zoning code; and
WHEREAS, in accordance with RCW 35.63.200, moratoriums must be renewed
after one year and every six -months thereafter; and
WHEREAS, the City Council did decide on March 24, 1997, to renew the existing
residential subdivision moratorium for another six -months; and
WHEREAS, the City Council did hold a public hearing on April 28, 1997 to take
testimony, review materials and consider all information presented regarding the renewal of the
moratorium; and
WHEREAS, the City Council expects to complete their review in the next several
months and adopt a new zoning code; and
WHEREAS, the City Council did hold a public hearing on September 22, 1997 to
take testimony, review materials and consider all information presented regarding the renewal of
the existing moratorium, now, therefore,
THE CITY OF PORT ORCHARD CITY COUNCIL DOES RESOLVE AS
FOLLOWS:
THAT the City does renew the residential subdivision moratorium for another six
months with the following facts and findings.
Fact: (1) The Zoning Code must be consistent with the adopted Comprehensive Plan.

(2) The City Council is meeting twice per month to specifically discuss the draft
zoning code and expects to complete their review within the next several months.
(3) No members of the public submitted written or verbal testimony at either the City
Council meeting on March 24, 1997 or the public hearing on April 28, 1997,
concerning the renewal of the moratorium.
Finding: (1) The draft Zoning Code is consistent with the adopted Comprehensive Plan
because it includes more flexible development standards.
(2) A six-month renewal of the residential subdivision will not significantly affect
development within the city.
Conclusion: Based on testimony, materials presented and findings of fact, the City Council of
the City of Port Orchard does hereby renew the residential subdivision
moratorium for a period of six months which will expire on March 25, 1998.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor
and attested by the Clerk in authentication of such passage this 22nd day of September, 1997.
