A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
DESIGNATING KITSAP COUNTY AS THE LEAD AGENCY FOR
DEVELOPMENT OF A COMPREHENSIVE SOLID WASTE MANAGEMENT
PLAN.
WHEREAS, Chapter 70.95.020 RCW assigns primary responsibility for
solid waste planning to local government; and
WHEREAS, Chapter 70.105.007(3) RCW assigns responsibility for
moderate risk waste planning to local government; and
WHEREAS, for solid waste and moderate risk waste planning purposes,
Kitsap County attributes to the federally -recognized tribes the same status as
a city, as referred to in Chapter 70.95 RCW and Chapter 70.105 RCW; and
WHEREAS, Chapter 70.95.090 RCW requires the comprehensive solid waste
management plan to include the estimated long-range needs for solid waste
handling facilities projected twenty years into the future; and
WHEREAS, Chapter 70.95.110 RCW requires all solid waste management
plans to be maintained in a current condition to be reviewed and revised
periodically as may be required by the Department of Ecology; and
WHEREAS, Chapter 70.95.130 RCW requires a city preparing an
independent solid waste management plan to provide for disposal sites wholly
within its jurisdiction; and
WHEREAS, Chapter 70.95.080 RCW requires each City to (1) prepare an
independent solid waste management plan for integration into the county plan; or
(2) enter into an agreement with the County to participate in the preparation of
a joint City -County plan; or (3) authorization of the County to prepare a plan
for the City's solid waste management for inclusion in the County Comprehensive
Solid Waste Management Plan; and
WHEREAS, Chapter 70.105.220 RCW requires each local government to
prepare a local hazardous waste management plan which may be amended as the need
arises; and
WHEREAS, local governments may choose to either include a moderate
risk waste element in their solid waste plans, or develop moderate risk waste
plans separately from their solid waste plans, recognizing that if a local
government chooses not be combine the two plans, both plans should be
coordinated; and

WHEREAS, the 1990 Kitsap County Final Moderate Risk Waste Management
Plan is separate from the Kitsap County Solid Waste Plan, in the interest of
management and administrative efficiency Kitsap County is desirous of including
this plan as an element of the solid waste management plan; and
WHEREAS, Chapter 70.95.010 RCW, as amended by SHB1671, state the
solutions to the state's solid waste management problems require regional
solutions by local governments as well as intergovernmental cooperation; and
WHEREAS, Kitsap County has established a Solid Waste Advisory
Committee in accordance with Chapter 70.95.165 RCW to assist in the development
and review of programs and policies concerning solid waste handling and disposal;
and
WHEREAS, the Solid Waste Advisory Committee consists of
Representatives of the incorporated cities, Indian tribes, federal facilities,
County Commissioners' districts, and solid waste industry of Kitsap County; and
WHEREAS, the City of Port Orchard participated in the preparation of
the 1990 Comprehensive Solid Waste Management Plan, the 1992 Amendment, and the
1990 Moderate Risk Waste Management Plan through its representative on the Solid
Waste Advisory Committee; and
WHEREAS, it is necessary for grant application purposes to designate
the lead solid waste planning agency, establish the size of the planning area,
and for local governments participating in the solid waste management planning
process to obtain resolutions for the planning process;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES
HEREBY RESOLVE THAT:
(1) Kitsap County, shall act as lead agency for
review of the 1990 Kitsap County Compressive
Solid Waste Management Plan (1990 CSWMP) and the
1992 Amendment to the 1990 Kitsap County
Comprehensive Solid Waste Management Plan (1992
CSWMP Amendment), and for preparation of a
Revised Comprehensive Solid Waste Management Plan
(Revised CSWMP).
(2) Kitsap County is authorized to review solid waste
planning for the City of Port Orchard for
inclusion in the Revised CSWMP.
(3) Kitsap County is authorized to review the
moderate risk waste planning for the City of Port
Orchard contained in the 1990 Kitsap County Final
Moderate Risk Waste Management Plan, and to
prepare a Revised Moderate Risk Waste Management
Plan for the City of Port Orchard to be
incorporated in the Revised CSWMP.

(4) It is understood that the work associated with
resolution item #2 and #3 will be coordinated
through the Solid Waste Advisory Committee,- and
that the Department of Ecology will consider
approval of the Revised CSWMP only after all
local jurisdictions participating in the CSWMP
planning process have adopted the Revised CSWMP
by resolution.
PASSED by the City Council of the City of Port Orchard, APPROVED by
the Mayor and attested by the Clerk in authentication of ch passage this 24th
