1706 - Resolution - Conditional Use PermitRESOLUTION NO. 1706 rll� A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON PROVIDING A CONDITIONAL USE PERMIT FOR THE PORT ORCHARD ANNAPOLIS PEDESTRIAN WALKWAY. WHEREAS, the City adopted the revised Shoreline Master Program in 1992 to regulate the property within the jurisdiction of that Program; and WHEREAS, the project referred to as the Annapolis Pedestrian Walkway received a Determination of Non Significance; and WHEREAS, a public hearing was held on August 14, 1995 by the City Council to hear facts and testimony concerning granting a conditional use with regard to the Shoreline Management Program; and WHEREAS, the City Council has determined that the granting of a conditional use is consistent with the intent of the Shoreline Management Program; THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE THE FOLLOWING: The City of Port Orchard recommends approval to the Department of Ecology for the granting of a conditional use permit to allow the construction of the Port Orchard Annapolis Pedestrian Walkway with the following conditions: 1. The concrete walkway will be no more than eight (8) feet in width to reduce any potential shadowing effects which may be deleterious to fish or other biota as requested by the Department of Fisheries and Wildlife. 2. No building permit, excavation permit or other City approval will be issued for the construction of the walkway until the Department of Fisheries and Wildlife approves (or waives) the requirement for a Hydraulic Application Permit. 3. This walkway is site plan specific and all construction must be consistent with the drawings submitted to the City Council and conditions of approval stated here. PASSED by the City Council the Mayor and attested by the Clerk in day of August, 1995.
