RESOLUTION NO. 1662 ✓
A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING RESOLUTION NO. 1549 BY DELETING CONDITION NO.
4 WHICH REQUIRED A CONCRETE SIDEWALK, CURB AND GUTTER,
PER CITY STANDARDS AND NECESSARY DRAINAGE IMPROVEMENTS
SHALL BE CONSTRUCTED FOR THE LENGTH OF THE PROPERTY,
FOR PROPERTY LOCATED AT 700 MITCHELL AVENUE, (U.S. West
NewVector Group, Inc., Owner of Record).
WHEREAS, Resolution No. 1549 approved a Special Use Permit to allow
an 80 foot communications tower for cellular telephones and an equipment
building, located at 700 Mitchell Avenue, with 5 conditions, and
WHEREAS, U.S. West NewVector Group, Inc., subsequently petitioned
the City Council of the City of Port Orchard to rescind Condition No. 4, which
required U.S. West NewVector Group, Inc., to construct a section of concrete
sidewalk, curb and gutter along Mitchell Avenue, and
WHEREAS, the City Council of the City of Port Orchard held a public
hearing on February 28, 1994 to hear testimony and public input on the request
to delete Condition No. 4, and
WHEREAS, the City Council of the City of Port Orchard concluded that
deleting Condition No. 4 would not be detrimental to the health, safety,
morals and general welfare of the community,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS:
That Condition No. 4 of Resolution No. 1549 is deleted as a
condition of the Special Use Permit for the communication tower, contingent
upon approval of all documents by city attorney and acceptance and recording
of deed for Parcel B - Port Orchard Short Plat S-1076, as recorded in Kitsap
County Auditor File No. 9403010211.
