PORT ORCHARD CITY OF JUL 61 1994s 2: 18 PM KAREN' FLYNN# AUDITOR RESOLUTION NO. 160-E!K/ CONNELL A RESOLUTION OF THE CITY OF PO M # !rl06 20-7 APPROVING THE ISSUANCE OF A SPE R 2633 DARRELL AND MILLIE CULLIMORE FOR PROPERTY LOCATED AT 322 CLINE AVENUE FOR A SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS IN HARMONY WITH THE VARIOUS ELEMENTS OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS NOT DETRIMENTAL TO EXISTING USES PERMITTED IN THAT PARTICULAR ZONE. 9407060207 THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES HEREBY RESOLVE: THAT: Whereas the City Planning Commission has held the required public hearings in accordance with the criteria set forth in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and; WHEREAS, the City Planning Commission has recommended approval of the application by W. Darrell and Millie Cuilimore, located 322 Cline Avenue and has recorded with the City Clerk their decision setting forth their findings and recommendations. NOW, THEREFORE, the City Council of the City of Port Orchard does adopt Planning Commission Resolution No. 209-94, (Attachment "A") with Findings, Facts and Conclusions as their own and does hereby approve the issuance of a Special Use Permit to allow a conversion of a church site into a tuxedo shop, with the following eight conditions: 1. A minimum of seven parking spaces are designated. All parking stalls shall be striped and marked including handicap parking. Concrete or painted wheel stops can be used to define parking spots. 2. A lighting plan must be submitted and approved prior to the placement of outdoor illumination and it shall be orientated away from surrounding residences. 3. Signage shall be in compliance with the adopted Uniform Sign Code and must be approved by the City prior to implementation. 4. A Building Permit is required if there is to be any major interior reconstruction. Resolution No. 1667 Page 2 of 2 5. Landscaping in the form of hedges or trees shall be added to the northern boundary of the site to buffer potential adverse impacts to the adjoining residence. This landscaping shall be maintained. 6. Before any future change in occupancy, the Planning Commission and City Council shall review and approve the proposed use to ensure it is still in the best interest of the City residents. 7. Present and future businesses located on this property will register with the City. 8. If complaints are received by the City regarding this use, the Special Use Permit must be brought back in to the Planning Commission and City Council for review. DARRELL AND MILLIE CULLIMORE. THE PLANNING COMMISSION RESPECTFULLY RECOMMENDS THAT THE CITY COUNCIL CONSIDER A SPECIAL USE PERMIT FOR THIS SPECIFIC ADDRESS. LEGAL DESCRIPTION: SEE EXHIBIT A. WHEREAS, a Public Hearing was held on Monday, 18 April 1994, and the Planning Commission considered the findings and facts of the proposal, testimony, and materials presented at the Hearing; and WHEREAS, the applicants requested a land use reclassification from Residential High to Commercial General for the purposes of operating a tuxedo/prom dress shop; and WHEREAS, the Planning Commission considers the specific use proposed to be appropriate, however, it finds the reclassification of the property not to be appropriate; and WHEREAS, the Planning Commission finds that the proposal is not in the furtherance of health, safety, morals, and general welfare of the community; and WE THEREFORE FIND: that the proposed land use reclassification to Commercial General is not compatible with the surrounding land uses and will have a detrimental effect on the surrounding community. CONCLUSION, based on the facts, testimony, and materials presented at the Hearing, we therefore conclude that the reclassification from Residential High to Commercial General is not in harmony with the general purposes of the Zoning Ordinance.
