A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
ESTABLISHING POLICIES TO DIMINISH THE POTENTIAL PROBLEMS
AND/OR APPEARANCE OF PROBLEMS THAT CAN ARISE AS A RESULT
OF CLOSE RELATIVES WORKING FOR A COMMON EMPLOYER.
WHEREAS, WAC 162-16-150(3) and (7) provide regulations regarding nepotism,
and,
WHEREAS, the City Council desires to establish a policy to diminish the
potential problems and/or appearance of problems that can arise as a result of
close relatives working for a common employer.
NOW, THEREFORE, the City Council of the City of Port Orchard does hereby
adopt the following policy on the "Employment of Relatives":
EMPLOYMENT OF RELATIVES POLICY
The City of Port Orchard will not hire any new employees who are
related to present, regular, full-time management level employees,
including first line supervisors or elected officials, in the
following relationships who are living at/within the same household
as the employee:
Spouse
Child
Grandchild
# Brother, including in-laws and step or half
Sister, including in-laws and step or half
Any other relative residing in the same household as the
employee
This policy must also be considered when assigning, transferring, or
promoting an employee. Employees who marry may continue employment
as long as it does not:
(a) Create a supervisory relationship with one spouse having
authority over the other for hiring, disciplinary or wages.
(b) Create either an actual conflict of interest or the
appearance of a conflict of interest. (example: a relative
of a department director or first line supervisor, under the
age of 18 and/or living in the same household as the
employee.)
If one of these conditions should occur, attempts will be made to
find a suitable position within the City to which one of the
employees will transfer. If accommodations of this nature are not
feasible, the employees will be permitted to determine which of them
will resign.
