A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON, PROVIDING A CONDITIONAL USE
PERMIT AND VARIANCE FOR SHIPWATCH SHORES.
WHEREAS, the City adopted the revised Shoreline Master Program in
1992 to regulate the property within the jurisdiction of that Program; and
WHEREAS, the project referred to the Shipwatch Shores received a
Mitigated Determination of Non Significance; and
WHEREAS, a public hearing was held on September, 12 1994 by the City
Council to hear facts and testimony concerning granting a conditional use and
variance with regard to the Shoreline Management Program; and
WHEREAS, the City Council has determined that the granting of a
conditional use and variance is consistent with the intent of the Shoreline
Management Program;
THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY
RESOLVE THE FOLLOWING:
The City of Port Orchard recommends approval to the Department of
Ecology for the granting of a conditional use to allow the construction of
Shipwatch Shores, as depicted in the application for Substantial Development
Permit 56-94, which would include:
C1. Short subdivision into four residential lots.
C2. Construction of a community dock.
C3. Repair of revetment.
The City of Port Orchard recommends approval to the Department of
Ecology to grant a variance for the following matters:
V1. Elimination of the setback requirement.
V2. Elimination of the Vegetation Maintenance Corridor
requirement.
V3. The existing vegetation does not have to be retained.
V4. Extension of the community dock past the -10 foot contour.

The City of Port Orchard recommends approval to the Department of Ecology
to grant a conditional use permit and variance with the following conditions:
1. No building permit, excavation permit or other City approval
will be issued for any portion of Shipwatch Shores until the
Department of Fisheries approves or waives the requirement for
a Hydraulic Application Permit.
2. Shipwatch Shores is site plan specific and all construction
must be consistent with the drawings submitted to the City
Council.
3. All ingress and egress onto State Road 166 shall be approved
by the Washington Department of Transportation.
4. The homes shall be connected to City water and sewer. The
utility extension shall be approved by the City. All
construction and expense is the responsibility of the property
owner.
5. Building permit applications shall contain erosion control
plans, stormwater designs and landscape plans. No permit shall
be issued until these issues are shown to be consistent with
the Shorelands Management Program.
PASSED by the City Council of the City of Port Orchard, APPROVED by
the Mayor and attested by the Clerk in authentication of such passage this 26th
day of September, 1994
