A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON DENYING
THE ISSUANCE OF A SPECIAL USE PERMIT TO ROGER A. HUNKO,
ROBERT C. ZORNES, J.D. AND A.J. BUCHANAN FOR PROPERTY
LOCATED AT 803 ADA STREET FOR A SPECIFIC USE OF A PARCEL OF
PROPERTY WHICH IS NOT IN HARMONY WITH THE VARIOUS ELEMENTS
OR OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS DETRIMENTAL
TO EXISTING USES PERMITTED IN THAT PARTICULAR ZONE.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY RESOLVE:
THAT: Whereas the City Planning Commission held the required public
hearing in accordance with the criteria set forth in Chapter 6 (Special Use Permits)
of Ordinance No. 1469, Zoning Ordinance of the City of Port Orchard, and
WHEREAS, the City Planning Commission has recommended denial of the
application by Roger A. Hunko, etal. for property located at 803 Ada Street, and has
recorded with the City Clerk their decision setting forth their findings and
recommendations, and
WHEREAS, the Port Orchard City Council held a public hearing on August
23, 1993 to consider the Hunko, etal Special Use Permit Application, and
WHEREAS, the Port Orchard City Council did consider testimony and
evidence relevant to the Special Use Permit Application.
NOW, THEREFORE, the City Council of the City of Port Orchard does
hereby deny the issuance of a Special Use Permit to Roger A. Hunko, Robert C.
Zornes, J.D. and A. J. Buchanan for property located at 803 Ada Street based upon
the following findings of fact and conclusions:
FINDINGS OF FACT:
1) Subject property is located on the east side of Sidney Avenue.
Resolution No. 1636 (4) restricts the location of government
offices and other private businesses associated with County
government to the area depicted in the Kitsap County Facalities
Master Plan which is bounded by Dwight Street, Cline Avenue,
Sroufe Street and Sidney Avenue.
2) Parking for professional offices requires one (1) space for each
400 square feet of gross floor area.
The technical and engineering aspects of parking for the subject
property have not been resolved.

CONCLUSION: Based on the findings of facts, testimony and materials presented at
the public hearing, the Port Orchard City Council conclude that:
(1) A special use permit to allow professional offices at 803 Ada
Street would not be in harmony with the general purposes and intent of
Resolution 1636, the city zoning ordinance nor surrounding
comprehensive plan designations.
(2) The proposed use of the subject property is not compatible with
the surrounding residential neighborhood.
(3) The proposed use of the subject property is not in furtherance to
the health, safety, morals and general welfare of the community.
LEGAL DESCRIPTION: Lots 4, 5 and 6, Block 1, Pederson's First
Addition to Sidney, as per plat recorded in Volume 2 of Plats, on page 448, records
of Kitsap County. Excepting thereform the west 1.5 feet of said Lots for streets;
situate in Kitsap County, Washington.
PASSED by the City Council of the City of -Port Orchard, APPROVED by the
Mayor and attested by the Clerk in authentication of such passage this 13th day of
September, 1993.
