A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON
DENYING REQUEST AS SUBMITTED BY JERRY CLARK, (Developer) TO
REVISE CONDITION NO. 8 OF THE WINDFALL PLACE SUBDIVISION.
WHEREAS, Jerry Clark, Developer, has petitioned an amendment to
Ordinance No. 1576, requesting a revision to Condition No. 8 of the Windfall
Place Subdivision for property located in the 1700 and 1800 blocks of Pottery
Avenue, and
WHEREAS, The Council of the City of Port Orchard did hold a Public
Hearing on September 13, 1993 to hear testimony of fact and conclusion as
follows:
FINDINGS OF FACT: The use requesting a revision of
Condition No. 8 of the Windfall Place Subdivision is not
compatible with other uses in area.
CONCLUSION: Based on testimony, materials presented and
findings of fact, the Port Orchard City Council does
hereby conclude that granting this revision of Condition
No. 8 of the Windfall Place Subdivision would be
detrimental to the health, safety, morals and general
welfare of the community.
NOW, THEREFORE, be it ordained that the Council of the
City of Port Orchard, Washington does hereby deny the revision of
Condition No. 8 of the Windfall Place Subdivision as submitted by
Jerry Clark, Developer, for property located in the 1700 and 1800
blocks of Pottery Avenue.
PASSED by the City Council of the City of Port Orchard, SIGNED by
the Mayor and attested by the Clerk in authentication of such passage this
27th day of September, 1993.
