A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON DENYING THE ISSUANCE OF A SPECIAL
USE PERMIT TO DENNIS AND BEVERLY JANSON FOR
PROPERTY LOCATED AT 504 SIDNEY AVENUE FOR A
SPECIFIC USE OF A PARCEL OF PROPERTY WHICH IS
NOT IN HARMONY WITH THE VARIOUS ELEMENTS OR
OBJECTIVES OF THE COMPREHENSIVE PLAN AND IS
DETRIMENTAL TO EXISTING USES PERMITTED IN THAT
PARTICULAR ZONE.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES
HEREBY RESOLVE:
THAT: Whereas the City Planning Commission held the
required public hearing in accordance with the criteria set forth
in Chapter 6 (Special Use Permits) of Ordinance No. 1469, Zoning
Ordinance of the City of Port Orchard, and
WHEREAS, the City Planning Commission has recommended
approval of the application by Dennis and Beverly Janson, located
at 504 Sidney Avenue, and has recorded with the City Clerk their
decision setting forth their findings and recommendations, and
WHEREAS, the Port Orchard City Council held a public
hearing on July 13, 1992 to consider Dennis and Beverly Janson's
Special Use Permit Application, and
WHEREAS, the Port Orchard City Council did consider
testimony and evidence relevant to the Special Use Permit
Application.
NOW, THEREFORE, the City Council of the City of Port
Orchard does hereby deny the issuance of a Special Use Permit to
Dennis and Beverly Janson for property located at 504 Sidney
Avenue based upon the following findings of fact and conclusions:
FINDINGS OF FACT:
1) The subject property is inadequate to support a
commercial office use due to insufficient parking.
A portion of parking areas designated would
require vehicles to back onto Sidney Avenue to
exit. Sidney Avenue is a main traffic
thoroughfare.
2) The proposed use of the subject property is not
compatible with the surrounding residential
neighborhood based on vehicular ingress/egress.

CONCLUSION: Based on the findings of facts, testimony and
materials presented at the public hearing, the
Port Orchard City Council conclude that a special
use permit to allow professional offices at 504
Sidney Avenue would not be in harmony with the
general purposes and intent of the zoning
ordinance and surrounding comprehensive plan
designations.
LEGAL DESCRIPTION: Section 36, Township 24, Range
01E, Block 18, Lot 8, of the S.M. Steven's Town Plat of Sidney,
Plat recorded in Vol. 1 of Plats, Page 1 in Kitsap County.
PASSED by the City Council of the City of Port Orchard,
APPROVED by the Mayor and attested by the Clerk in authentication
of such passage this 10th day of August, 1992.
