A RESOLUTION OF THE CITY OF PORT ORCHARD
APPROVING THE ISSUANCE OF A VARIANCE
AUTHORIZING RELIEF FROM THE MINIMUM FRONT
YARD SETBACK REQUIREMENTS OF THE ZONING
ORDINANCE, AS SUBMITTED BY DOUG FIDE, FOR 528
& 534 DEKALB STREET.
LEGAL DESCRIPTION: Lots 9, 12, 13 and the West 20 feet
of Lot 16, Block 2, Plat of "S.M. Stevens" Township Plat of Sidney.
Section 26, Township 24 N, Range I E, W.M.
WHEREAS, the applicant has requested a variance of
the front yard setback requirement from fifteen (15) feet to within
five (5) feet of the DeKalb Street right of way, and
WHEREAS, the SEPA checklist submitted for the variance
request received a declaration of non -significance, and
WHEREAS, a public hearing was held on May 14, 1990 which
was continued to May 29, 1990 and the the City Council considered
the findings of facts, the testimony and material presented at the
hearing, and
WHEREAS, the City Council has recommended approval for a
zone reclassification from Residential -High to Multiple Family 20,
and
WHEREAS, the request for a variance is in conjunction
with a request for a rezone, and
WHEREAS, the applicant proposal is to construct eleven
(11) dual level condominiums with garages beneath the living area on
a parcel located at 528 and 534 DeKalb Street, and
WHEREAS, the property is located in an old established
neighborhood which has a mixture of residential and commercial uses,
and
WHEREAS, a majority of the residences located in the
neighborhood do not meet the existing setback requirements, and
WHEREAS, due to the severe grades and the poor soil
conditions, without a variance maximum utilization of the property
would be cost prohibitive.
WE, THEREFORE FIND: that a variance to allow
construction within 5 feet of the front property line will not be
detrimental or injurious to other properties in the neighborhood.

CONCLUSION: Based on the findings of facts, the
testimony and materials presented at the public hearing, we
therefore conclude that in the evidence presented, all four (4) of
the conditions required by Ordinance No. 1469, Chapter VI, A, exist
in reference to the property being considered.
BE IT RESOLVED, that the City Council of the City of
Port Orchard hereby approves the issuance of a variance to allow the
construction of condominiums within five (5) feet of front property
line. The variance to be issued in conjunction with approval of the
zone reclassification.
PASSED by the City Council of the City of Port Orchard,
APPROVED by the Mayor and attested by the Clerk in authentication
of such passage this 11th day of June, 1990
