A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON DENYING ZONE RECLASSIFICATION
OF CERTAIN PROPERTY (Big Tree Land
Company, owner of record) LOCATED AT 910
and 912 Taylor Street.
WHEREAS, Big Tree Land Company, owner of record, has
petitioned a zoning ordinance amendment, requesting reclassification
of property located at 910 and 912 Taylor Street as described in
said petition, and
WHEREAS, The City of Port Orchard Planning Commission
has transmitted to the Council of the City of Port Orchard,
Washington a copy of their Resolution No. 151-90 - ATTACHMENT "A"
recommending denial of said petition, and
WHEREAS, The Council of the City of Port Orchard did
hold a Public Hearing on August 13, 1990 to hear testimony of fact
and conclusion as follows:
FINDINGS OF FACT: The use requested is not
compatible with other uses in area.
The proposed use is not a permitted use within
Residential Low Zoning.
CONCLUSION: Based on testimony, materials
presented and findings of fact, the Port
Orchard City Council does hereby conclude that
granting this zone reclassification would be
detrimental to the health, safety, morals and
general welfare of the community.
NOW, THEREFORE, be it ordained that the Council
of the City of Port Orchard, Washington does hereby adopt
of Planning Commission Resolution No. 151-90 with Findings
of Fact and Conclusion.
PASSED by the City Council of the City of Port Orchard,
SIGNED by the Mayor and attested by the Clerk in authentication of
such passage this 27th day of August, 1990.

PLANNING COMMISSION
RESOLUTION NO. 151-90
A RESOLUTION BY THE PORT ORCHARD PLANNING COMMISSION
RECOMMENDING THAT THE CITY COUNCIL DENY A ZONE
RECLASSIFICATION FROM RESIDENTIAL LOW TO RESIDENTIAL.
HIGH, AS SUBMITTED BY THE BIG TREE LAND COMPANY
FOR 910 AND 912 TAYLOR STREET.
LEGAL DESCRIPTION: Section 26, Township 24 North, Range 1 East
AIM, Kitsap County: That portion of the southeast quarter of the
southeast quarter defined as follows: Beginning at a point 667
feet south and 370 feet east of the northwest corner of said
subdivision, thence east 20 rods (330 feet), thence south 8 rods
(132 feet), thence west 20 rods (330 feet), thence north 8 rods
(132 feet), to the point of beginning; excluding the east half
thereof, excluding the south 80 feet of the west 72 feet thereof,
excluding the south 50 feet, and excluding roads.
WHEREAS, the applicant has requested a rezone to Residential High
in order to construct a duplex at the southeast corner of Taylor
Street and Harrison Avenue.
WHEREAS, a public hearing was held on Monday, 16 duly 1990, and
the Planning Commission considered the findings of facts,
the testimony and material presented at the hearing, and
WHEREAS, a SEPA checklist has been submitted and has received a
declaration of non -significance, and
WHEREAS, the Comprehensive Plan designation of the property is
Residential Low,
WHEREAS, the neighborhood is residential served by dead end
roads, and
WHEREAS, numerous members of the neighborhood objected to the
project because it would increase the density, add to the traffic
and change the character of the neighborhood, and
WHEREAS, neither the applicant nor anyone else spoke for the
project,
WE THEREFORE FIND: that a rezone from Residential Low to
Residential High is inconsistent with the development in the
neighborhood.
CONCLUSION: Based on the findings of facts, the testimony and
materials presented at the public hearing, we therefore conclude
that a zone reclassification from Residential Low to Residential
High would not be in harmony with the general purposes and
would not meet the intent of the zoning ordinance and
comprehensive plan.

BE IT RESOLVED, that the Planning Commission of the City of Port
Orchard hereby respectfully requests that the City Council
deny a zone reclassification from Residential Low to Residential
High on a parcel located at the southeast corner of Taylor Street
and Harrison Avenue, as submitted by the Big Tree Land Company.
