A RESOLUTION OF THE CITY OF PORT ORCHARD
APPROVING THE ISSUANCE OF A SPECIAL USE PERMIT
TO THOMAS CARLYLE FOR A SPECIFIC USE OF A
n +� PARCEL OF PROPERTY WHICH IS IN HARMONY WITH THE
- VARIOUS ELEMENTS OR OBJECTIVES OF THE
S �5 ' - 12'gtb COMPREHENSIVE PLAN AND IS NOT DETRIMENTAL TO
EXISTING USES PERMITTED IN THAT PARTICULAR
ZONE.
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES HEREBY
RESOLVE:
THAT: Whereas the City Planning Commission has held the
required public hearings in accordance with the criteria set forth in
Chapter 5 (Special Use Permits) of Ordinance No. 1163, Zoning Ordinance of
the City of Port Orchard, and;
WHEREAS, the City Planning Commission has recommended approval
of the application by Thomas Carlyle, and has recorded with the City Cleric
their decision setting forth their findings and recommendations.
NOW, THEREFORE, the City Council of the City of Port Orchard
does adopt Planning Commission Resolution No. 135-89, with Findings, Facts
and Conclusions as their own and hereby approves the issuance of a Special
Use Permit to allow the construction of a 233 unit mini -storage facility,
together with an office and a resident managers apartment located on the
northwest corner of SR160 and the high school access road, in accordance
with the conditions imposed by Ordinance No. 1163, Chapter 5 and subject to
the following conditions: (1) That an agreement concomitant with the rezone,
be signed and recorded, securing the City the right to construct and assess
for; a sewermain, watermain with hydrants if other than City utilities are
used; (2) That an agreement concomitant with the rezone be signed and
recorded, securing the City the right to construct and assess for road
improvements needed to mitigate the impacts of the commercial development;
(3) That authorization for use of the high school access road for ingress &
egress, as shown be signed and recorded; (4) Prior to making any
improvements of the property such as land clearing and/or other
construction, a silt and erosion control plan shall be submitted to the City
Engineer and be approved.
LEGAL DESCRIPTION: The northerly 405 feet of that portion of
the southeat quarter of the southwest quarter, Section 25, Township 24
North, Range I East, W.M., in Kitsap County, Washington, described as
follows: Beginning at the southwest corner of the east half of the
southeast quarter of said southwest quarter; thence north 660 feet; thence
east 209 feet; thence south 627 feet; thence west 197 feet; thence south 33
feet; thence west to the point of beginning; except State Highway No. 14
along the south boundary.
