A RESOLUTION OF THE CITY OF PORT
ORCHARD APPROVING THE ISSUANCE OF
SPECIAL USE PERMIT TO JOAN CASE FOR A
SPECIFIC USE OF A PARCEL OF PROPERTY
LOCATED AT 904 DWIGHT WHICH IS,IN
HARMONY WITH THE VARIOUS ELEMENTS OR
OBJECTIVES OF THE COMPREHENSIVE PLAN
AND IS NOT DETRIMENTAL TO EXISTING
USES PERMITTED IN THAT PARTICULAR
ZONE.
THE CITY COUNCIL.OF THE CITY OF PORT ORCHARD DOES
HEREBY RESOLVE:
THAT: Whereas the City Planning Commission has
held the required public hearings in accordance with the
criteria set forth in Chapter 5 (Special Use Permits) of
Ordinance No. 1163, Zoning Ordinance of the City of Port
Orchard, and,
WHEREAS, the Council of the City of Port Orchard
did hold a Public Hearing on April 13, 1987 to hear testimony
and review materials presented and does set forth Findings of
Fact and Conclusion as follows:
FINDINGS OF FACT: 1. The area of the proposed
Special Use Permit is presently zoned residential
high. This zoning designation permits, certain
neighborhood commercial uses such as professional
offices upon issuance of a Special Use Permit.
2. The proposed use is in
harmony with the objective of the comprehensive
plan and is not detrimental to existing uses.
3. The site is adequate in
size and shape to accommodate the proposed law
office (main floor), apartment (second floor) and
storage (basement).
4. The building is adequate
to support the proposed.use.
CONCLUSION: Based on testimony, materials
presented and Findings of Fact, the Port Orchard
City Council does hereby conclude that granting
this Special Use Permit would not be detrimental
to the health, safety, morals and general welfare
of the community.
NOW THEREFORE, the City Council of the City of
Port Orchard does hereby approve that a Special Use Permit to
allow.a law office (.main floor), apartment (second floor) and
storage (basement) be issued in accordance with the
conditions imposed by Ordinance No. 1163, Chapter 5.
