A RESOLUTION OF THE CITY OF PORT
ORCHARD APPROVING THE ISSUANCE OF
SPECIAL USE PERMIT TO LLOYD TRAIL
FOR A SPECIFIC USE OF A PARCEL OF
PROPERTY WHICH IS IN HARMONY WITH
THE VARIOUS ELEMENTS OR OBJECTIVES
OF THE COMPREHENSIVE PLAN AND IS
NOT DETRIMENTAL TO EXISTING USES
PERMITTED IN'THAT PARTICULAR ZONE
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD
DOES HEREBY RESOLVE:
THAT: Whereas the City Planning Commission
has held the required public hearings in.accordance with the
criteria set, forth in Chapter 5 (Special Use Permits) of
Ordinance No. 1163, Zoning Ordinance of the City of Port
Orchard, and;
WHEREAS, the City Planning Commission has
recommended approval of the application of Lloyd Trail, and
has recorded with the City Clerk their decision setting forth
their findings and recommendations.
NOW, THEREFORE, the City Council of the City
of Port Orchard does hereby adopt the findings and
conclusions of the Port Orchard Planning Commission as it's
own (Planning Commission Resolution No. 70-86, Attachment
"A") and does hereby approve that a Special Use Permit be
issued in accordance with conditions imposed by Ordinance No.
1163, Chapter 5 allowing a retail sales of miscellaneous new
and used merchandise to be located at 1883 Bay Street with
the following condition: "Parking does not encroach into
street or upon the future sidewalk along Bay Street
LEGAL DESCRIPTION: Lots 13, 14,
and 15 Block 34 Annapolis,
recorded in Volume 1 of Plats,
pages 64 & 65, as per records of
Kitsap County, Washington.
PASSED by the City Council of the City of Port
Orchard, signed by the Mayor and attested by the Clerk in
authentication of such passage this 27th day of October,
1986.

A RESOLUTION BY THE PORT ORCHARD PLANNING COPS MiSSION RECOMMENDING
THAT TILE Cfl'Y COUNCIL APPROVE A SPECIAL USE PERMfT FOR 1882 BAY,
AS SUBMITTED BY LLOYD TRAIL.
LEGAL, DESCRIPTION: Lots 13, 141 & 15 Block 34 Annapolis, recorded in volume 1 of
Plats, pages 64 &65, as per records of Kitsap County, Washington
WHEREAS, the applicant has requested a special use permit for his residence
located at 1883 Bay, in order allow retail sales of miscellaneous new and
used merchandise, and
WIIFREAS, a public hearing was held on 15 September 1986 and that the Planning
Commission considered the findings of facts, the testimony and material presented
at the hearing, and
WHERFAS, a SF.PA checklist has been submitted and has received a dec?aration of
non -significance, and
WHEREAS, the use applied for is a proper one for which a Permit is authorized by
Ordinance 1163, and
WHEREAS, the site for the intended use is adequate in size and shape to
accornodate retail sales of miscellaneous new and used merchandise.
W.F., THEREFORE FIND: That the special use permit for the proposed retail store
would be in the public interest; is desirable for the development of the community,
is in harmony with the various elements or objectives of the Coin preliensive Plan,
and is not detrimental to existing uses in the neighborhood.
CONCLUSION: Based on the findings of facts, the testimony and materials presented
at the public hearing, we therefore conclude that granting the special use pc�rniit
as requested, would be in harmony with the general purposes and intent of the
zoning ordinance and comprehensive plan.
BE If' RESOLVED, that the Planning Commission of the City of Port Orchard hereby
respectfully requests that the City Council approve the special use permit as
requested, subject to the condition of approval that:
Parking dries not encroach into right-of-way or upon the future sidewalk along
Bay St reet
