1435 - Resolution - Accept Funds for Investigation and ApprehensionRESOLUTION NO. 1435 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING THE PORT ORCHARD CITY TREASURER TO ACCEPT FUNDS FOR THE INVESTIGATION AND APPREHENSION OF PERSONS CRIMINALLY INVOLVED IN THE SALE, DISTRIBUTION AND USE OF NARCOTIC AND DANGEROUS DRUGS. WHEREAS, it appears that the Superior Court of Kitsap County in the exercise of its authority in imposing judgment and sentence in criminal cases may order that particular defendants pay, as a part of such sentence, certain sums of money to the City of Port Orchard, to be used by law enforcement agencies in the investigation and apprehension of persons involved in the illicit sale, distribution and use of drugs, and WHEREAS, it appears that the Kitsap County Superior Court will impose such condition in appropriate cases. NOW THEREFORE, BE IT RESOLVED, that the Port Orchard, City Treasurer is authorized and directed to accept such funds as the Kitsap County Superior Court shall order paid, or any other municipality or court or person or organization shall tender, to be spent and applied for the purpose of investigation and apprehension of persons criminally involved in illicit sale, distribution or use of narcotic or dangerous drugs or controlled substances. Such monies, as are accepted, are to be placed in a Special Revenue Fund for the purchase of drugs and substances, as well as for such expenses as are reasonable and necessarily incident thereto. PROVIDED, that the Port Orchard Police Chief shall be responsible for implementation and maintenance of such accounting procedures as will record advancement of funds from the Special Investigative Unit Imprest Fund and return to the Port Orchard Police Chief of funds advanced but not expended. The status of the fund shall be reported to the Mayor and City Council quarterly; PROVIDED further, the Port Orchard City Treasurer shall establish a Special Invesigative Unit Imprest Fund which shall be funded in accordance with the provisions of Ordinance No. 1365; AND PROVIDED FURTHER, that should the Port Orchard Police Chief determine that the continued maintenance of such fund is unnecessary or uncalled for, such funds as are then held by the Port Orchard City Treasurer or Port Orchard Police Chief shall be remitted to the General Fund of the City, or if the Kitsap County Superior Court shall so order, to such persons as that the Court shall direct.
