1290 - Resolution - Intent to Initiate Formation of Utility Local Improvement District No. 1CITY OF PORT ORCHARD, WASHINGTON RESOLUTION NO. 1290 A RESOLUTION of the City Council of the City of Port Orchard, Washingtonā€˛ declaring its intention to initiate the formation of Utility Local Improvement District No. 1 to carry out the plan for additions to and betterments and extensions of the Waterworks Utility of the City as specified and adopted in Ordinance No. 1220, and to create a utility local improvement district to assess the cost and expense of carrying out such improvements against the properties specially benefited thereby, and notifying all persons who desire to object to the improvements to appear and present their objections at a hearing before the City Council to be held on April 4 & 4., 1983. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, as follows: Section 1. It is the intention of the City Council of the City of Port Orchard, Washington (the "City"), to order the improvement of the properties within the area described. in Exhibit A attached hereto and by this reference made a part hereof (including all properties within the corporate limits of the City and Sewer District No. 5, Kitsap County, Washington (the "District"), and certain properties outside the corporate boundaries of the City and District) by the: 1. Conversion of the existing Port Orchard primary treatment plant in downtown Port. Orchard to a 7.5 mgd capacity sewage pump station; 2. Construction of a new 18-inchdiameter, 8,000 foot long sewage force main from the new Port Orchard marina pump station to the site of the existing primary treatment plant operated by the District at Retsil; 3. Construction of a new 2.8 mgd:average wet weather flow capacity secondary treatment plant at the site of the existing District facility; 4. Construction of a new 36-inch diameter treated effluent outfall pipe approximately 2,000 feet into Sinclair Inlet with a multi -port diffuser; and 5. Relocation of.the District office; in accordance with the plan of additions to and betterments and extensions of the Waterworks Utility of the City specified and adopted by Ordinance No. 1220, passed November 11, 1982. Section 2. The total estimated cost and expense of the improvements is declared to be $16,000,000 and approximately $8,200,000 of such cost and expense shall be paid from grant funds anticipated to be received from the State of Washington, Department of Ecology, and the balance thereof shall be borne by and assessed against the property specially benefited by such improvements to be included in a utility local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvements, which assessments shall be for the sole purpose of payment into a bond redemption fund for the payment of water and sewer revenue bonds to be issued by the City. Section 3. All persons who may desire to object to the improvements described herein are notified to appear and present such objections at a hearing before the City Council to be held in South Kitsap High School Auditorium in Port Orchard, Washington, at 7:30 p.m., local time, on April 4 &5,1983, which time and place are fixed for hearing all matters relating to the proposed improvements and all objections thereto and for determining the method of payment for those improvements. All persons who may desire to object thereto should appear and present their objections at such hearing. Any person who may desire to file a written protest with the City Council may do so within thirty days after the date of passage of the ordinance ordering the improvement in the event the utility local improve- ment district is formed. Such written protest should be signed -2- by the property owner and should include the legal description of the property for which the protest is filed and such protest should be delivered to the City Clerk. Section 4. Kramer, Chin & Mayo, Inc., consulting engineers, are directed to submit to the City Council on or prior to April 4,.. 1983, all data and information required by law to be submitted. The foregoing resolution was ADOPTED by the City Council of the City of Port Orchard, Washington, at a regular open public meeting thereof, this 28th day'of February, 1983.
