1321 - Resolution - ULID No. 1CITY OF PORT ORCHARD RE S OLUT I ON NO. % 3 2. % L/' A RESOLUTION of the City Council of the City of Port Orchard, declaring its intention to include certain omitted properties within Utility Local Improvement District No. l and to assess or reassess those properties, and notifying all persons who desire to object to the inclusion and the assessment to appear and present their objections at a hearing before the City Council to be held on November 2, 1983. WHEREAS, by Ordinance No. 1231, adopted April 11, 1983, the City Council of the City of Port Orchard (the "City") estab- lished Utility Local Improvement District No. 1 ("ULID No. 1") in order to pay part of the cost of certain additions, exten- sions and betterments to the City's Waterworks Utility (the "Improvements"); and WHEREAS, by Ordinance No. 1237, adopted July 25, 1983, the City Council approved and confirmed the assessments and assess - went roll of ULID No. 1; and WHEREAS, a technical error in the legal description of ULID No. 1, contained in Exhibit A to Ordinance No. 1231, caused the omission from ULID No. 1 of a small number of properties spe- cially benefited by the Improvements; those properties, listed at Exhibit A to this resolution (incorporated here by this reference), were therefore omitted from the assessment roll approved and confirmed by Ordinance No. 1237; and WHEREAS, the owners of certain properties within ULID No. 1, listed at Exhibit B to this resolution (incorporated here by this reference), were not given notice of the proceedings relating to ULID No. 1 as required by law and were therefore omitted from the assessment roll approved by Ordinance No. 1237 of the City; and WHEREAS, RCW 35.44.280 through 35.44.380 provide a proce- dure for the reassessments of properties and assessments on omitted properties (herein collectively referred to as "assess- ments"); and WHEREAS, the Superior Court of the State of Washington for Kitsap County, by Order dated August 5, 1983, in Cause Nos. 83-2-00529-1 and 83-2-00581-9, found at paragraph 18 that "[t]he City should be allowed to correct the legal description of ULID No. 1 and proceed with any supplemental reassessment proceedings that may be required"; and WHEREAS, Kramer, Chin & Mayo, consulting engineers, have reported to the City Council of the City of Port Orchard (the "City Council") the amounts that should be borne by each lot, tract or parcel of land or other property listed in Exhibits A and B. and such amounts are stated on such Exhibits; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, as follows: Section 1. It is the intention of the City Council to amend the assessment roll approved and confirmed by Ordinance No. 1237, in order to assess the properties listed at Exhibits A and B to this resolution, to pay for a part of the cost of the Improvements. Such properties are or shall then become a part of ULID No. 1, and all payments of assessments of those proper- ties shall be paid and become part of the fund created to pay for the Improvements. Section 2. All persons who may desire to object to the amendment of the assessment roll approved and confirmed by Ordinance 1237, or to protest or object to the amount of the assessments shown on Exhibits A and B of this resolution, are T notified to make their objections in writing and to file them with the City Clerk at or prior to a hearing before a special committee of the City Council to be held in the Active Club in Port Orchard, Washington, at 10:00 a.m., local time, on November 2, 1983. After such hearing, and upon considering the recommendation of the special committee, the City Council will sit as a board of equalization for the purpose of considering - 2 - the assessments shown at Exhibits A and B, will consider the objections raised, and may correct, revise, raise, lower, change, modify or set aside the proposed assessments or order that the assessments be made de novo. Section 4. By the filing of this resolution with the City Clerk, the proposed amendments to the assessment roll approved and confirmed by Ordinance 1237 shall be deemed to have been filed. Section 5. The City Clerk is authorized and directed to mail a notice, substantially in the form contained at Exhibit C (incorporated here by this reference), to the owner or reputed owner of each of the properties contained at Exhibits A and B, at the address shown on the tax rolls of the county treasurer. The City Clerk is further authorized and directed to publish a notice, substantially in the form contained at Exhibit D (incor- porated here by this reference) in accordance with the require- ments of RCW 35.44.090. ADOPTED by the City Council of the City of Port Orchard, Washington, at a regular open public meeting, this /4 t- day of October, 1983.
