A RESOLUTION OF THE CITY OF PORT ORCHARD
AUTHORIZING.THE MAYOR TO SIGN CONTRACT
WITH THE STATE OF WASHINGTON; DEPARTMENT
OF VETERANS' AFFAIRS FOR PURCHASE OF
ADDITIONAL PROPERTY FOR THE WASTEWATER
TREATMENT FACILITY
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD DOES
RESOLVE
THAT: The Mayor of the City of Port Orchard be
and her is authorized to sign the Contract with the
State of Washington; Department of Veterans' Affairs for
purchase of additional property as described in`attached
Contract. Additional property is for the Wastewater
Treatment Facility located next to the Retsil Veterans
Home.
PASSED by the City Council and APPROVED by the
Mayor of the City of Port Orchard on this loth day of
October, 1983.

CONTRACT ADDENDUM
WHEREAS, the State of Washington, DEPARTMENT OF VETERANS' AFFAIRS, acting through
the DEPARTMENT OF GENERAL ADMINISTRATION (hereinafter referred to as "State") and
the CITY OF PORT ORCHARD, a Washington municipal corporation (hereinafter referred
to as "City"), entered into a contract dated April 20, 1982, and recorded in the
office of the Auditor of Kitsap County, Washington on July 6, 1982 under file
No. 8207060074 for the sale by State to City of certain lands located in Kitsap
County and more thoroughly described therein; and
WHEREAS, an error has been discovered in the legal description of Tract D described
therein; and
WHEREAS, the parties hereto have agreed to the sale of additional land by State to
City;
NOW, THEREFORE, it is agreed by and between the parties as follows:
(1) "the State agrees to sell to the City and the City agrees to purchase from
the State, additional lands situated in the Northeast quarter of Section 25,
Township 24 North, Range 1 East W.M., shown--oa1ered i-ft-red on the attached
Exhibit "A".
(2) This purchase shall be on the following terms and conditions:
The purchase price shall be $12,150.00. This amount will be added to the
escrow account established by the Contract dated April 20, 1982 and herein
referenced and under the same terms and conditions.
(3) The State reserves a construction easement 20 feet wide adjacent to the
concrete surface of its approach road for the purpose of widening its
approach road.
(4) The City will adhere to the conditions stated in the letter from the Mayor
of City dated April 17, 1980, a copy of which is attached as Exhibit "B".
(5) All utilities to the Veterans Home will be reconnected at no cost to State.
The Department of Veterans' Affairs will review and approve relocation plans
of any affected utilities prior to construction. Approval wil_1 not be
unreasonably withheld.
(6) The legal description of Tract D is corrected to read as follows:
TRACT D: Beginning at quarter corner between Section 25, Township 24
North, Range 1 East, W-11. 8nd Section 30, Township 24 North, Range 2
East, W.M.; thence North 0 12'21" East 1, 924.48 feet along the East
line of said Section 25 to the centerline of County goad (Bay Street);
thence North 73 40' West 221.4 feet; thence North 86 41'40" West 684.22
feet; thence South 3018'20" West 50 feet to a point on t8e South right-
of-way line of County Road (Bay Street); thence North 86 41'40" West
90.00 feet along said righ�-of-way line to the Northwesterly corner of
Tract "C"; thence South 03 18'20" West 358.00 feet to the Southwesterly
corner of Tract "C", which is also the true point of beginning of
Tract "D"; thence South 0301q'20" West 100.g0 feet; thence South
86 41'40" East ?g75.10 feet; thence North 03 18'20" East 100.00 feet;
thence North 86 41'40" West 275.10 feet to the point of beginning.
