OF A JOINT HOUSING AUTHORITY.

Clerk of the City of Port Orchard. Upon written request a statement of the full text

AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, AMENDING ORDINANCE NO. 1181 §4 AS
AMENDED BY THE CITY OF PORT ORCHARD, ORDINANCE NO.
1227 §4, AN ORDINANCE PROVIDING FOR FORMATION OF A
JOINT HOUSING AUTHORITY.
WHEREAS, the City of Port Orchard, Washington, is a part of a joint housing authority
as authorized by RCW 35,82.300 under the title of "Kitsap County Consolidated Housing Authority."
WHEREAS, every housing authority in the State of Washington, is authorized to do
any and all things necessary or desirable to secure the financial aid or cooperation of the federal
government in the undertaking, construction, maintenance or operation of any housing project by such
authority pursuant to RCW 35.82.200.
WHEREAS, the Kitsap County Consolidated Housing Authority has in the past and will
in the future secure the financial aid and cooperation of the federal government.
WHEREAS, the United States Housing Act of 1937, as amended (42 U.S.C. 1437 now
mandates that the membership of the Kitsap County Consolidated Housing Authority Board of
Commissioners shall contain not less than one (1) member who is directly assisted by the authority.
WHEREAS, the authority to.establish the appointment and tenure of the housing
authority's commission is vested in the legislative authorities comprising the joint city -county housing
authority pursuant to RCW 35.82.300(2).
WHEREAS, the present commission membership requirements must be amended to
include at least one (1) individual who is directly assisted by the authority so that the housing authority
may continue to secure the financial aid and cooperation of the federal government, now, therefore,
THE CITY COUNCIL_ OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 1227 §4 and 1181 §4 are hereby amended to read as
follows:
Appointment and Tenure of Commission. The Kitsap County Consolidated Housing
Authority shall be governed by a board of seven (7) commissioners composed of the following:
(1) Elected Officials. The elected members of the Board of Commissioners of Kitsap
County, the Mayor of Port Orchard, the Mayor of Poulsbo, and the Mayor of Bainbridge
Island.
(a) Appointment to the Board of Commissioners of the Kitsap County
Consolidated Housing Authority as a result of holding such elective
office shall take effect upon election and confirmation of office as a
county or municipal official. A certificate of appointment or re-
appointment to the Board of Commissioners of the Kitsap County
Consolidated Housing Authority shall be filed with the Clerk of said
Ordinance No. 1766

Board and such certificate shall be conclusive evidence of the due and
proper appointment of such commissioner.
(b) Each commissioner shall hold office during his/her tenure as an elected
official of the county or municipality respectively and he/she shall
continue to hold office until his/her successor has been appointed.
(2) Participant. One (1) individual, who is directly assisted by the Kitsap County
Consolidated Housing Authority, elected by a majority affirmative vote of the above
Elected Officials, who shall serve for a tern of two -years. Such individual participant
Board Member may be removed from the office by a two-thirds affirmative vote of the
above Elected Officials.
SECTION 2. Savings Clause. Ordinance No. 1227 §4, and Ordinance No. 1181
§4, which have been amended by this ordinance, shall remain in force and effect until the effective date
of this ordinance.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor
and attested by the Clerk in authentication of such passage this 23rd day August 1999.
