AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON AMENDING ORDINACE NO. 1652 BY
AUTHORIZING A ONE YEAR EXTENSION FOR THE
PRELIMINARY PLAT OF GOLDEN POND SUBDIVISION.
PROPERTY LOCATED ON THE WEST SIDE OF POTTERY
AVENUE, 400 FEET SOUTH OF MELCHER STREET AND
ADDRESSES CONSISTING OF PROPERTIES AT 1280, 1290
AND 1330 POTTERY AVENUE.

WHEREAS, J & H Limited Liability Partnership and their representative Keene
Engineering, submitted an application for preliminary plat to allow a subdivision of
approximately 10 acres of property located on the west side of Pottery Avenue, 400 feet south
of Melcher Street and addresses consisting of properties at 1280, 1290 and 1330 Pottery
Avenue, and
WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing on
May 13, 1996 adopting Ordinance No. 1652 with 34 conditions approving Preliminary Plat of
Golden Pond Subdivision and,
WHEREAS, Ordinance No. 1619, Section allows an applicant to file a written
request with the City Council at least thirty days before the expiration of the three-year period
granting a one year extension to the applicant upon showing that the applicant has attempted in
good faith to submit the final plat within the three year -period, and
WHEREAS, AES Consultants, Inc. representing James T. James the owner of
the plat of Golden Pond Subdivision, submitted a letter on February 20, 1998 to the City Council
requesting a one year extension for the Final Plat of Golden Pond, and
WHEREAS, The Council of the City of Port Orchard did at their regular
scheduled Council meeting on March 23, 1998 authorize a one year extension for the Final Plat
of Golden Pond, now, therefore,

FINDINGS OF FACT: The applicant has in good faith attempted to submit the
final plat within the three years as requested by Ordinance No. 1619.
CONCLUSION: Based on findings of fact, the Port Orchard City Council does
hereby conclude that approving this one year extension for this Preliminary Plat would not be
detrimental to the health, safety, morals and general welfare of the community, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:
That an extension of one year be granted to the Preliminary Plat of Golden Pond
Subdivision, to allow compliance with the 34 conditions as granted in Ordinance No. 1652.
