AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON AMENDING ORDINANCE NO. 1635 BY
AUTHORIZING A ONE YEAR EXTENSION FOR THE
PRELIMINARY PLAT OF ROCKPORT SUBDIVISION.
PROPERTY LOCATED APPROXIMATELY IN THE 900-1000
BLOCK OF OLNEY AVENUE (WEST SIDE).

WHEREAS, Jim James, applicant, submitted an application for preliminary plat
to allow a subdivision of approximately 12.81 acres of property located in the in the 900-1000
block of Olney Avenue (WestSide), and
WHEREAS, the Council of the City of Port Orchard did hold a Public Hearing on
April 8, 1995 adopting Ordinance No. 1635 with 33 conditions approving Preliminary Plat of
Rockport Subdivision and,
WHEREAS, Ordinance No. 1619, Section 4 allows an applicant to file a written
request with the City Council at least thirty days before the expiration of the three-year period
granting a one year extension to the applicant upon showing that the applicant has attempted in
good faith to submit the final plat within the three year -period, and
WHEREAS, AES Consultants, Inc. representing James T. James the owner of
the plat of Aldan Place, submitted a letter on February 20, 1998 to the City Council requesting a
one year extension for the Final Plat of Rockport, and
WHEREAS, The Council of the City of Port Orchard did at their regular
scheduled Council meeting on March 23, 1998 authorize a one year extension for the Final Plat
of Rockport, now, therefore,
FINDINGS OF FACT: The applicant has in good faith attempted to submit the
final plat within the three years as requested by Ordinance No. 1619.

CONCLUSION: Based on findings of fact, the Port Orchard City Council does
hereby conclude that approving this one year extension for this Preliminary Plat would not be
detrimental to the health, safety, morals and general welfare of the community, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:
That an extension of one year be granted to the Preliminary Plat of Rockport
Subdivision, to allow compliance with the 33 conditions as granted in Ordinance No. 1635.
(Jim James, applicant and owner for property.) Expiration date March 23, 1999.
PASSED by the City Council of the City of Port Orehard, signed by the Mayor
and attested by the Clerk in authentication of such passage this " day of April, 1998.
