AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, ESTABLISHING THE FIRE AUTHORITY FOR
THE CITY OF PORT ORCHARD; PROVIDING FOR THE
APPOINTMENT THEREOF; AND, DESIGNATING THE DUTIES
AND RESPONSIBILITIES THEREOF.
WHEREAS, the City of Port Orchard currently operates and maintains its own fire
department to provide comprehensive fire suppression, fire prevention, review and inspection
services, emergency medical services, emergency hazardous substances response services and
other services incidental to the protection of persons and property in the City of Port Orchard, and
WHEREAS, the Kitsap County Fire District No. Ts jurisdictional boundaries adjoin
those of the City of Port Orchard, and
WHEREAS, the Kitsap County Fire District No. 7 is capable of providing services
currently provided by the City of Port Orchard Fire Department, and
WHEREAS, review of fire protection services has determined that combining
comprehensive services will result in significant savings to the citizens of Port Orchard and
provide more efficient fire protection services the citizens of Port Orchard and the South Kitsap
community, and
WHEREAS, the City of Port Orchard and Kitsap County Fire District No. 7 have
entered into an Agreement for the District to provide fire protection to the City commencing
January 3, 1998, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON
DOES ORDAIN AS FOLLOWS:
SECTION 1. FIRE AUTHORITY ESTABLISHED: Effective January 3,1998, the
Port Orchard City Council hereby establishes the Fire Authority for the City of Port Orchard.
SECTION 2. APPOINTMENT OF THE FIRE AUTHORITY. Effective January 3,
1998, Kitsap County Fire District No. 7 is hereby appointed and recognized as the Fire Authority
for the City of Port Orchard.
SECTION 3. DUTIES AND RESPONSIBILITIES: As set forth in the Fire
Protection Agreement signed by the City and the District, the Fire Authority shall provide
enhanced service levels to those currently provided by the City of Port Orchard Fire Department
for comprehensive fire suppression services, emergency medical services, and emergency
hazardous substances response services; and, with respect to fire prevention services, review
and inspection services and other services incidental to the protection and public safety of the
persons and property in the City of Port Orchard as established by state or city statutes.

The Fire Authority shall be in full and complete charge of the volunteer firefighters, career
firefighters and administrative fire personnel and shall have supervision and control of all fire
apparatus and shall have the authority to enforce ordinances and resolutions of the city. The Fire
Authority shall be in absolute charge at all fires and shall have the police powers of the chief of
police at and in the vicinity of all fires, and the orders of the Fire Authority shall be obeyed while in
charge at a fire.
PASSED by the City Council of the City of Port Orchard, APPROVED by the
Mayor and attested by the Clerk in authentication of such passage this 22nd day of December,
1997.
