ORDINANCE NO. 1653
AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; BY
AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING
.85 ACRES INTO AN OFFICE COMPLEX CONSISTING OF TWO (2)
OFFICE BUILDINGS FOR PROPERTY LOCATED AT 1989 BETHEL
AVENUE, (Richard L. Granquist, applicant).
WHEREAS, the contract purchaser, Richard L. Granquist, has petitioned
a zoning ordinance amendment, requesting reclassification of .85 acres of
property located 1989 Bethel Avenue, and
WHEREAS, The City of Port Orchard Planning Commission has transmitted
to the Council of the City of Port Orchard, Washington a copy of their Resolution
No. 261-96- ATTACHMENT "A" recommending approval of said petition, and
WHEREAS, The Council of the City of Port Orchard did hold Public
Hearings on April 8, 1996 to hear testimony of fact and conclusion as follows:
FINDINGS OF FACT: The use requested is compatible with
other uses in area.
The proposed use is a permitted use within Commercial
General.
CONCLUSION: Based on testimony, materials presented and
findings of fact, the Port Orchard City Council does
hereby conclude that granting this zone reclassification
would not be detrimental to the health, safety, morals
and general welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PORT
ORCHARD, WASHINGTON THAT: The Council of the City of Port Orchard does hereby
adopt Planning Commission Resolution No. 261-96 with Findings of Facts, as their
own and does hereby reclassify certain property from Residential Low to
Commercial General to allow an office complex consisting of two (2) office
buildings on approximately .85 acres.

A RESOLUTION BY THE CITY OF PORT ORCHARD PLANNING
COMMISSION REQUESTING THE CITY COUNCIL APPROVE A
RECLASSIFICATION FROM RESIDENTIAL LOW TO COMMERCIAL
GENERAL WHICH WOULD ALLOW DEVELOPMENT OF .85 ACRES INTO A
PROFESSIONAL OFFICE COMPLEX AT 1989 BETHEL AVENUE.
LEGAL DESCRIPTION:
THAT PORTION OF THE NORTHWEST 'A OF THE NORTHWEST '/a OF
SECTION 36, TOWNSHIP 24 NORTH, RANGE 01 EAST, W.M., IN KITSAP
COUNTY WASHINGTON, DEFINED AS FOLLOWS: BEGINNING AT THE
SOUTHWEST CORNER OF SAID SUBDIVISION; THENCE NORTH 115.5 FEET;
THENCE EAST TO A POINT ON THE EASTERLY MARGIN OF STATE
HIGHWAY NO. 14 (BETHEL AVENUE); SAID POINT OF BEING THE TRUE
POINT OF BEGINNING OF PROPERTY HEREIN DESCRIBED; THENCE EAST
320 FEET; THENCE SOUTH 115.5 FEET MORE -OR -LESS TO THE SOUTH
LINE OF SAID NORTHWEST '/a OF THE NORTHWEST '/a; THENCE WEST
ALONG SAID SOUTH LINE OF SAID SUBDIVISION TO THE EAST MARGIN
OF STATE HIGHWAY 14; THENCE NORTHEASTERLY ALONG SAID EAST
MARGIN TO THE TRUE POINT OF BEGINNING.
WHEREAS, a Public Hearing was held on Monday, March 18, 1996, and the Planning
Commission considered at length the findings and facts of the proposal, testimony, and materials
presented at the Hearing; and
WHEREAS, the applicant requested approval to Reclassify .85 acres from Residential
Low to Commercial General which would allow development of a professional office complex
consisting of two (2) buildings; and
WHEREAS, the proposal is consistent with the Commercial General requirements; and
WHEREAS, this proposal complies with City standards for utilities and stormwater; and
WHEREAS, this proposal complies with Resolution Number 1482; and
WHEREAS, the development does therefore comply with the Comprehensive Plan and
Zoning Ordinance and is consistent with the objectives outlined therein.
WE THEREFORE FIND: That the Reclassification is compatible with surrounding land
uses and will not have a detrimental effect on the surrounding community.

CONCLUSION: Based upon the facts, testimony, and materials presented at the
Hearing, we therefore conclude the Reclassification from Residential Low to Commercial
General which would allow development of a professional office complex on .85 acres be in
harmony with the general purposes of the Zoning Ordinance and Comprehensive Plan.
BE IT RESOLVED, that the Planning Commission of the City of Port Orchard hereby
requests the City Council to approve the Reclassification for the above described property subject
to the following conditions:
1. Revised site plan shall be submitted and approved prior to issuance of any permits and
include the following:
a. Setbacks must meet Zoning Code requirements. Landscaping for west, east and
south portions of the development shall also comply with Zoning Code
requirements. A pedestrian link shall be provided to the adjacent Post Office site.
Quantity and spacing of trees on the north property line will comply with the
revised landscape plan submitted on March 18, 1996.
b. Parking spaces changed to 20 feet in length, spaces deleted in front of warehouse
garage doors and incorporate compact parking spaces into the design. Parking
lot islands are not required.
C. Access to allow joint use with property to the south.
d. Dumpster(s) and mailbox locations. Fencing and landscaping around dumpster(s)
incorporated in to design.
e. Sign meeting setback.
f. Show the ingress of the Post Office.
2. Sign permit required prior to installation. The sign shall not exceed 117 square feet and
comply with the Zoning Ordinance Chapter 5.6.13.8 & 9.
3. The reclassification shall be valid for a period of 18 months. If substantial progress
toward construction has not occurred at the expiration of this time period; the City
Council may revoke the new land use reclassification or approve an 18 month time
extension with conditions.
4. Addresses must be issued prior to building permit issuance.
5. The west 20 feet of the property be deeded to the City as right-of-way in accordance with
Resolution Number 1482.
6. The stormwater system shall be designed and constructed to meet the best management
practices as defined by the Department of Ecology.

7. All areas that have been disturbed during construction, but not constructed upon by 1
October of the year shall be hydroseeded or covered with straw to minimize sediment
erosion.
8. The stormwater system shall be designed by a professional engineer. The design will
include an analysis of the contributing stormwater flows to provide adequate protection
against flooding.
9. All stormwater system improvements will be complete prior to issuance of any certificate
of occupancy.
10. The site shall be surveyed and recorded.
11. At the time sidewalks are constructed along the frontage of the office complex, a separate
pedestrian walkway shall also be installed that connects the sidewalk to the office
building entrances.
12. All landscaped areas shall be irrigated by automatic sprinklers. An irrigation plan shall
be submitted prior to issuance of any permits.
13. All planting materials found dead or diseased within one (1) year of installation shall be
replaced at the property owners expense.
14. A lighting plan shall be submitted and approved prior to issuance of any permits.
