AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING ORDINANCE NO. 1594 TO REVISE OLYMPIC TERRACE
APARTMENTS PROJECT SITE PLAN AND APPROVE PHASE TWO WITH 10
CONDITIONS. PROJECT LOCATED IN THE 700 BLOCK OF OLNEY
AVENUE, NORTH OF K-MART PLAZA AND SOUTH SOUND CINEMA.

WHEREAS, the Port Orchard City Council did on November 8, 1993 approve
Ordinance No. 1594 to reclassify property located in the 700 block of Olney Avenue,
North of K-Mart Plaza and South Sound Cinema from Commercial General to Multiple
Family 20 to allow 207 apartments with twenty-four (24) conditions; and
WHEREAS, William Palmer and Richard Brown, representing Olympic Terrace
Associates, subsequently has submitted an application to revise the site plan for
Phase Two project; and
WHEREAS, project proponents have requested approval of Phase Two of the
multi -phase Olympic Terrace Apartment Project; and
WHEREAS, the Council of the City of Port Orchard did consider revisions
to the site plan for Phase Two of Olympic Terrace Apartments on May 13, 1996; and
WHEREAS, the Council of the City of Port Orchard did consider input and
testimony on the proposed Phase Two of Olympic Terrace Apartments Project and did
determine facts and conclusion as follows:
FINDINGS OF FACT:
THAT: The applicants were granted a site specific rezone as conditioned
in Ordinance No. 1594; and
THAT: The applicants submitted an amended site plan for Phase Two of
the multi -phase development; and
THAT: The Council considered the amendments substantial and determined
that as conditioned a public hearing was necessary.
CONCLUSION: Based on testimony, materials presented and findings of
fact, the Port Orchard City Council does hereby conclude that (1) the revision to
Phase Two of a multi -phase project would not be detrimental to the health, safety,
morals and general welfare of the community; (2) it is in the best interest of the
community to allow the site plan revisions for Phase Two of Olympic Terrace
Apartments (with conditions); and (3) the original 24 conditions set forth in
Ordinance No. 1594 are retained and in effect for all future phases of the Olympic
Terrace Apartment Project.
NOW, THEREFORE, be it ordained that the Council of the City of Port
Orchard, Washington does hereby ordain as follows:
That Phase Two of the Olympic Terrace Apartments, is hereby approved
with the following 10 conditions:

1. Approval to reduce dwelling units from 66 to 25 in the Phase Two
portion.
2. Approval for amending Orlando Street access to Phase Two, to stay
within the 122. grade maximum as submitted on revised Site plan.
3. Access to Phase Three must be provided through Phase Two.
4. Approval to delete garages from the site plan and construct only
carports.
5. Approval to reduce number of structures to 3. Approval to locate
structures in locations as submitted on revised site plan.
6. Approval to allow 1.5 inch caliper trees.
7. Phase Two must contain one Tot Lot.
8. A lighted, safe pedestrian access must be provided for the apartments
toward the adjacent shopping area as required in the original
conditions of approval. (Ordinance No. 1594).
9. Orlando Street must have a concrete sidewalk for its full length of
development.
10. Street illumination needs to be provided contingent upon City
Engineer's requirements.
