AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; BY
AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING
1.76 ACRES INTO 4 LOTS TO ALLOW A SHORT PLAT SUBDIVISION
LOCATED AT 209 TRACY AVENUE, (Brad Reid, applicant).
Tax Account No. 362401-3-010-2007 Legal Description: Portions of
Blocks 1, 4 and vacated Singleton Avenue, Plat of "Fowler's Re -Plat of Wheeler
& Singleton's Addition", as recorded in Volume 2 of Plats, at page 84, records
of Kitsap County, Washington, situated within the NE 1/4 of the SW 1/4 of Section
25, T 24, R 1 E, W.M. A- F. #-. 961'l 140110
WHEREAS, the applicant, Brad Reid, has petitioned a zoning ordinance
amendment, requesting reclassification of 1.76 acres of property located 209
Tracy Avenue, and REEL 0934 FR .2684
WHEREAS, affected property owners may request a change in valuation
for property tax purposes notwithstanding any program of revaluation, and
WHEREAS, The City of Port Orchard Planning Commission has transmitted
to the Council of the City of Port Orchard, Washington a copy of their Resolution
No. 266-96- ATTACHMENT "A" recommending approval of said petition, and
WHEREAS, The Council of the City of Port Orchard did hold Public
Hearings on October 14, 1996 to hear testimony of fact and conclusion as follows:
FINDINGS OF FACT: The use requested is compatible with
other uses in area.
The proposed use is a permitted use within Residential
High.
CONCLUSION: Based on testimony, materials presented and
findings of fact, the Port Orchard City Council does
hereby conclude that granting this zone reclassification
would not be detrimental to the health, safety, morals
and general welfare of the community.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PORT
ORCHARD, WASHINGTON THAT: The Council of the City of Port Orchard does hereby
adopt Planning Commission Resolution No. 266-96 with Findings of Facts, as their
own and does hereby reclassify certain property from Residential Low to
Residential High to allow a short plat subdivision of approximately 1.76 acres,
with the following 14 conditions:
1. One (1) street tree with a minimum height of 6 feet and 12 inches in
diameter shall be installed within the front yard of each dwelling unit
(i.e., two (2) street trees per duplex and one (1) per single family
residence) prior to Certificate of Occupancy excluding the existing single

2. Buildings, including accessory uses, shall cover not more than 409,. of the
total lot area.
3. The required off-street parking spaces shall not occupy more than 50% of
the required front yard setback. A revised site plan shall be submitted
showing the required parking meeting Chapter 17 of the Zoning Ordinance.
4. To reduce impact to the school system, mitigation fees will be paid at the
time of building permit issuance, if the City adopts a general
implementing ordinance for school impact fees prior to the date that a
complete building permit application is accepted. The proponent can also
mitigate the impact to the school system by negotiating a settlement with
the South Kitsap School District.
5. The water meters will be located in the right of way and not in the
private driveway.
6. The water services shall tap into the 6-inch water main in Tracy Avenue
and not the 12-inch main serving the reservoir.
7. All dwelling units shall be connected to sewer. This may require the
proposed homes to the east to pump the wastewater.
8. The street in the easement area shall be privately owned and have a
minimum 20 foot wide paved travelway.
9. Morton Street shall be paved to a width of 27 feet. No sidewalk is
required.
10. The applicant shall provide stormwater maintenance details in writing to
this office. The City will not maintain the stormwater system.
11. The short plat shall be surveyed and recorded.
12. The fire hydrant located at Tracy Avenue and Morton Street must be
upgraded and equipped with a 5-inch Storz fitting.

13. Details of the existing entry/access at Tracy Avenue and Morton Street
must be provided to the City Planning Department for review and comment.
14. Property owners to be responsible for the maintenance of the turn -around
portion of the development.
PASSED by the City Council of the City of Port Orchard, APPROVED by

WHEREAS, a Public Hearing was held on Monday, September 16, 1996, and the
Planning Commission considered at length the findings and facts of the proposal, testimony, and
materials presented at the Hearing; and
WHEREAS, the applicant requests approval to Reclassify 1.76 acres from Residential
Low to Residential High which would allow a short plat of four (4) lots; and
WHEREAS, the lot sizes are consistent with the Residential High requirements for single
family residential and duplex lots; and
WHEREAS, this proposal increases the variety of housing choices and increases the
housing density in an appropriate zone; and
WHEREAS, this proposal mitigates the request for increased density with respect to its
proximity to Annapolis Creek (which crosses the easterly portion of the property) by providing
on -site stormwater roof infiltration systems which are conveyed into a dispersal trench; and
WHEREAS, the development does therefore comply with the Comprehensive Plan and
Zoning Ordinance and is consistent with the objectives outlined therein.
WE THEREFORE FIND: That the Reclassification is compatible with surrounding land
uses and will not have a detrimental effect on the surrounding community.
CONCLUSION: Based upon the facts, testimony, and materials presented at the
Hearing, we therefore conclude that the Reclassification from Residential Low to Residential
High which would allow a short plat of 1.76 acres into four (4) lots would be in harmony with
the general purposes of the Zoning Ordinance and Comprehensive Plan.
