1671 - Ordinance - Revising Olympic Terrace Site PlanCity of Port Orchard 216 Prospect Stree Port Orchard, WA 983b6 ORDINANCE NO. 1671 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON REVISING A PORTION OF THE APPROVED OLYMPIC TERRACE SITE PLAN AND AUTHORIZING A JOINT USE PARKING LOT AGREEMENT BETWEEN OLYMPIC TERRACE APARTMENTS AND SOUTH SOUND CINEMA. PROJECT LOCATED IN THE 700 BLOCK OF OLNEY AVENUE, NORTH OF K-MART PLAZA AND SOUTH SOUND CINEMA. (Olympic Terrace Associates, owner; Richard Brown and William Palmer, Applicant.) Tax Account No. 302402-3-053-2000 Legal Description: SW Quarter of Section 30, Township 24 N, Range 1 East, Kitsap County. Full legal description - Attachment "A". WHEREAS, the Port Orchard City Council did on November 8, 1993 approve Ordinance No. 1594 to reclassify property located in the 700 block of Olney Avenue, North of K-Mart Plaza and South Sound Cinema from Commercial General to Multiple Family 20 to allow 207 apartments with twenty-four (24) conditions; and WHEREAS, William Palmer and Richard Brown, representing Olympic Terrace Associates, petitioned the City Council requesting authorization to allow a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema for a total of 69 parking spaces located on the southern most 65 feet of Olympic Terrace :site, the dimensions of the parcel are 65'x395'; and WHEREAS, affected property owners may request a change in valuation for property tax purposes notwithstanding any program of revaluation, and WHEREAS, the Council of the City of Port Orchard did consider revisions to the site plan to allow a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema on December 9, 1996; and WHEREAS, the Council of the City of Port Orchard did consider input and testimony on the revised site pland and proposed joint use parking lot between Olympic Terrace Apartments and South Sound Cinema and did determine facts and conclusion as follows: Ordinance No. 1671 Page Two of Two FINDINGS OF FACT: THAT: The applicants were granted a site specific rezone as conditioned in Ordinance No. 1594; and THAT: The applicants submitted an amended site plan to allow for a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema; and CONCLUSION: Based on testimony, materials presented and findings of fact, the Port Orchard City Council does hereby conclude that (1) the revision to the site plan to allow a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema would not be detrimental to the health, safety, morals and general welfare of the community; (2) it is in the best interest of the community to allow the site plan revisions to allow a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema; and (3) the original 24 conditions set forth in Ordinance No. 1594 are retained and in effect for this and all future phases of the Olympic Terrace Apartments. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DO ORDAIN AS FOLLOWS: (1) the revision to the site plan to allow a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema would not be detrimental to the health, safety, morals and general welfare of the community; (2) it is in the best interest of the community to allow the site plan revisions to allow a joint use parking lot between Olympic Terrace Apartments and South Sound Cinema; (3) the original 24 conditions set forth in Ordinance No. 1594 are retained and in effect for this and all future phases of the Olympic Terrace Apartments.
