AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; BY
AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING
15.43 ACRES OF PROPERTY LOCATED IN THE VICINITY OF 1030
OLNEY AVENUE, (Jim James, applicant).
WHEREAS, Jim James, applicant, has petitioned a zoning ordinance
amendment, requesting reclassification of 15.43 acres of property located in the
vicinity of 1030 Olney Avenue, and
WHEREAS, The City of Port Orchard Planning Commission has transmitted
to the Council of the City of Port Orchard, Washington a copy of their Resolution
No. 229-95- ATTACHMENT "A" recommending approval of said petition, and
WHEREAS, The Council of the City of Port Orchard did hold Public
Hearings on April 24, 1995 to hear testimony of fact and conclusion as follows:
FINDINGS OF FACT: The use requested is compatible with
other uses in area.
The proposed use is a permitted use within Residential
High.
CONCLUSION: Based on testimony, materials presented and
findings of fact, the Port Orchard City Council does
hereby conclude that granting this zone reclassification
would not be detrimental to the health, safety, morals
and general welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PORT
ORCHARD, WASHINGTON THAT: The Council of the City of Port Orchard does hereby
adopt Planning Commission Resolution No. 229-95 with Findings of Facts, as their
own and does hereby reclassify certain property from Residential Low to
Residential High to allow a subdivision of approximately 15.43 acres into 40
dwelling units for single family residences and not more than 4 duplex lots.
Legal Description: Portion of the south half of the Northeast
quarter of the Southeast Quarter of Section 25, Township 24 North,
Range 1 East, W.M., Kitsap County, Washington, lying westerly of
Olney Avenue; except portion deeded to Richard V. Krueger and Helen
Krueger Husband and wife, but auditor's file number 486008, recorded
in volume 482 on page 673, records of Kitsap County.

A RESOLUTION BY THE CITY OF PORT ORCHARD PLANNING
COMMISSION RECOMMENDING THE CITY COUNCIL APPROVE A
RECLASSIFICATION FROM RESIDENTIAL LOW TO RESIDENTIAL HIGH
FOR THE PROPERTY LOCATED ALONG THE WEST SIDE OF OLNEY
AVENUE, AS REQUESTED BY JIM JAMES.
LEGAL DESCRIPTION: SEE EXHIBIT A.
WHEREAS, a Public Hearing was held on Monday, 20 March 1995,
and the Planning Commission considered at length the findings and
facts of the proposal, testimony, and materials presented at the
Hearing; and
WHEREAS, the applicants requested a Reclassification from
Residential Low to Residential High to allow the creation of 49
dwelling units and no more than 4 duplex lots on 15.43 acres of
land; and
WHEREAS, the Planning Commission studied at length the
specific use proposed and found it to be appropriate as
conditioned; and
WHEREAS, the proposed use, as demonstrated in supporting
documentation provided by the applicant and as conditioned, will
not be detrimental to the public health, safety, welfare or
injurious to property and improvements in the vicinity and
therefore will be in conformance with the objectives of the
Comprehensive Plan.
WHEREAS, the Planning Commission and the applicants worked
together to serve the best interests of all; and
WE THEREFORE FIND: that the proposed reclassification from
Residential Low to Residential High is compatible with the
surrounding land uses and will not have a detrimental effect on the
surrounding community.
CONCLUSION, based on the facts, testimony, and materials
presented at the Hearing, we therefore conclude that the
Reclassification from Residential Low to Residential High to allow
the creation of a subdivision is in harmony with the general
Purposes of the Zoning Ordinance and the Comprehensive Plan.
