AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
VACATING A PORTION OF BAY STREET (within 1700 block) AND AN
UN -NAMED RIGHT-OF-WAY WHICH IS WEST OF BAY STREET BETWEEN
BLOCK 23 AND 32, PLAT OF ANNAPOLIS
WHEREAS, a Public Hearing on a Petition to Vacate a portion of Bay Street
(within 1700 block) and an un-named right-of-way which is located west of Bay Street
between Block 23 and 32, Plat of Annapolis further described as follows, in accordance
with RCW 35.79.035 was held Monday March 28, 1994 at 7:35 PM in the City Council
Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington, and
WHEREAS, the Petitioner, Randy Jones has sought the vacation because his
residence is situated within the platted right-of-ways, and
WHEREAS, the Petitioner has offered to trade Lots 3 & 4, Block 32 Plat of
Annapolis which lie south of city right-of-way on Mitchell Point, and
WHEREAS, the trade would to enable the city to acquire property for park
and public viewing purposes, and
WHEREAS, the City of Port Orchard did in 1985 adopted by Resolution No.
1392 the Urban Waterfront Walkway Plan (aka Kasprisin Plan) as part of the Comprehensive
Park Plan, and
WHEREAS, the Urban Waterfront Walkway Plan did compile an inventory of all
rights -of -way within the city that abut Sinclair Inlet, and
WHEREAS, the Urban Waterfont Walkway Plan does propose a resting/viewing
point at Mitchell Point, and
WHEREAS, a study of the area has determined that the subject right-of-ways
are not suitable for city use for any of the following purposes: port, boat moorage,
launching sites, beach or water access, park, public view, recreation or education, and
WHEREAS, the two parcels Lots 3 & 4, Block 32, Plat of Annapolis would be
suitable for city use as park, public view and recreation purposes, and
WHEREAS, the petitioner, Randy Jones has submitted $3,500.00 and also
offers deed to Lots 3 & 4, Block 32 of Annapolis Plat of property to serve as
compensation for the subject property, and
WHEREAS, the two parcels Lots 3 & 4, Block 32, Plat of Annapolis would be
suitable for city use as park, public view and recreation purposes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON
DOES ORDAIN AS FOLLOWS:
THAT: a portion of Bay Street which lies approximately 100 feet south of
Mitchell Point (approximately 2,975 square feet) together with the unnamed right-of-way
which is west of Bay Street between Blocks 23 and 32, Plat of Annapolis, (described as

follows) is vacated as petitioned by Randy Jones, with the conditioned upon receipt of
title on said Lots 3 & 4, Block 32 Plat of Annapolis which is free and clear of
encumbrances and defects except those acceptable to the City.
LEGAL DESCRIPTION: That portion of Government Lot 3, and the First Class
Tidelands adjoining Section 25, Township 24 North, Range 1 East, W.M., in
Kitsap County, Washington, described as follows: Commencing at the
Southeast corner of Lot 1, Block 23, Plat of Annapolis, according to the
plat thereof, recorded in Volume 1 of Plats, Page 64, records of Kitsap
County, Washington, which is the True Point of Beginning; thence 85 feet
Northeasterly along the West margin of the Bay Street right-of-way; thence
35 feet Southeasterly along a line perpendicular to the West margin of
said Bay street; thence 85 feet Southwesterly along a line parallel to the
West margin of said Bay street; thence 35 feet Northwesterly along a line
which is perpendicular to the West margin of said Bay street to the True
Point of Beginning AND TOGETHER WITH the un-named right-of-way which is
West of Bay Street and is between Blocks 23 and 32, Sidney Tidelands.
PASSED by the City Council of the City of Port Orchard, APPROVED by the
Mayor and attested by the Clerk in authentication of suchipassage this 11th day of
April, 1994. �
