1575 - Ordinance - Siting of Hazardous WasteNOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held March S, 1993. ORDINANCE NO. 1575 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING ORDINANCE 1469, CHAPTER 4 (DEFINITIONS); CHAPTER 5, SEC. 5.5; and CHAPTER 5, SECTION 5.7, RELATED TO THE SITING OF HAZARDOUS WASTE AND STORAGE FACILITIES. Copies of Ordinance No. 1575 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Thirty days after publication, copies of Ordinance No. 1575 will be provided at a nominal charge. City of Port Orchard '`/yHager C Michelle Deputy Clerk Publish: Port Orchard Independent March 17, 1993 ORDINANCE NO. 1575 AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING ORDINANCE 1469, CHAPTER 4 (DEFINITIONS); CHAPTER 5, SEC. 1/ 5.5; and CHAPTER 5, SECTION 5.7, RELATED TO THE SITING OF HAZARDOUS WASTE AND STORAGE FACILITIES. WHEREAS, in 1985 the Washington State Legislature passed House Bill 975 requiring that cities adopt zoning amendments allowing hazardous waste storage and treatment facilities in zones that allow uses which generate hazardous waste, excluding residential zones; and WHEREAS, this ordinance complies with the state requirements; and WHEREAS, the City of Port Orchard has complied with the State Environmental Policy Act and local SEPA policies. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: SECTION I: Ordinance No. 1469, Chapter 4 (Zoning Ordinance), is hereby amended to include the following definitions: ADD: HAZARDOUS WASTE. "Hazardous Waste" means all dangerous and extremely hazardous waste as defined in RCW 70.105.010(15), or its successor, except for moderate risk waste as set forth in ROW 70.105.010(17), or its successor. HAZARDOUS WASTE TREATMENT AND STORAGE FACILITY, ON -SITE. "On -site Hazardous waste treatment and storage facility: means treatment and storage facilities which treat and store hazardous wastes generated on the same property. HAZARDOUS WASTE TREATMENT AND STORAGE FACILITY, OFF - SITE. "Off -site hazardous waste treatment and storage facility" means treatment and storage facilities which treat and store hazardous wastes generated on a property other than those on which the offsite facilities are located. HAZARDOUS WASTE STORAGE. "Hazardous waste storage" means the holding of hazardous waste for a temporary period, as regulated by the State Dangerous Waste Regulations, Chapter 173-303 WAC, or its successor. HAZARDOUS WASTE TREATMENT. "Hazardous waste treatment " means the physical, chemical, or biological processing of hazardous waste for the purpose of rendering these wastes nondangerous or less dangerous, safer for transport, amenable for storage, or reduced in volume, as regulated by the State Dangerous Waste Regulations, Chapter 173-303 WAC or its successor. Ordinance No. 1575 Page 2 of 2 SECTION II: THAT Ordinance No. 1469 (Zoning Ordinance), Chapter 5, Section 5.5 is amended to read as follows: AMEND: Purpose: The "CH" or highway commercial district is designated to permit those activities which primarily serve the travelling public. It should be applied in those areas which have proper visual exposure to major traffic routes and transportation terminals. Uses in those districts should be developed in a planned manner affording the motorist the opportunity to acquire food, fuel, and/or lodging in a relaxing and aesthetically -pleasing environment. Onsite hazardous waste treatment and storage facilities are allowed as defined by State Dangerous Waste Regulations, Chapter 173-303 WAC or its successor, and provided such facilities comply with state siting criteria adopted in accordance with RCW 70,105.210, or its successor. SECTION III: THAT Ordinance No. 1469 (Zoning Ordinance), Chapter 5, Section 5.7 is amended to read as follows: AMEND: Purpose: The "I" or Industrial District shall provide for those uses of a light industrial or manufacturing nature which will contribute to the overall betterment of the community. Uses within this district should be developed in an attractively planned manner consistent with the residential integrity of the general area. Onsite and offsite hazardous waste treatment and storage facilities are allowed as defined by State Dangerous Waste Regulations, Chapter 173-303 WAC or its successor, and provided such facilities comply with state siting criteria adopted in accordance with RCW 70.105.210, or its successor.
