ORDINANCE
The following is a summary of an Ordinance approved by the Port Orchard City Council at their
regular Council meeting held August 9, 1993.
ORDINANCE NO. 1588
AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, AMENDING ORDINANCE NO. 1496 AND
ORDINANCE NO. 1035 TO INCLUDE AN ASSISTED LIVING
APARTMENT BUILDING WITHIN RIDGEMONT TERRACE - 2051
POTTERY AVENUE.
Copies of Ordinance No. 1588 are available for review at the office of the City Clerk of the City
of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed
to any interested person without charge. Thirty days after publication, copies of Ordinance No.
1588 will be provided at a nominal charge.

ORDINANCE NO. 1588
AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING
ORDINANCE NO. 1496 AND ORDINANCE NO. 1035 TO INCLUDE AN
ASSISTED LIVING APARTMENT BUILDING WITHIN RIDGEMONT
TERRACE - 2051 POTTERY AVENUE
WHEREAS, public hearings for the Ridgemont Terrace project were
held in 1978; and
WHEREAS, Ordinance No. 1035 approved the land use reclassification
and adopted three conditions recommended by the Port Orchard Planning
Commission; and
WHEREAS, Condition No. 3 was not to include the proposed
additional 20 unit structure located at the rear of the property; and
WHEREAS, Ordinance No. 1496 amended Ordinance No. 1035 to correct
a clerical error and properly designate the zone classification designation
set by council action in 1978 with the three conditions of approval;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS;
THAT Ordinance No. 1496 which was approved on November 13, 1990
and Ordinance No. 1035 which was approved on January 23, 1978 be amended to
read as follows:
Whereas, Donald Ostrom (Ridgemont Terrace) has initiated a zoning
ordinance amendment, requesting reclassification of property described in said
petition, and all legal requirements have been performed; and
Whereas, the City of Port Orchard Planning Commission has
transmitted to the Council of the City of Port Orchard, Kitsap County
Washington, a copy of the City of Port Orchard Planning Commission's findings
and action recommending that the Zoning Map be amended and for the reasons
stated therein;
Now, Therefore, Be It Ordained that the Council of the City of
Port Orchard, does hereby adopt the findings and recommendations of the
Planning Commission, as it's own and does hereby reclassify certain property
to MF-20 as is legally described herein; Subject to Conditions No. 1 and 2 of
the Inter -Department Memorandum dated June 28, 1977 (3 conditions -Exhibit A).

Legal Description: That portion of the Southwest quarter of the Northwest
quarter, Section 2, Township 23 North, Range 1 East, W.M., in Kitsap County
Washington described as follows: Commencing at the Northwest corner of said
Southwest quarter of the Northwest quarter, the true point of beginning;
thence South 3*13 7' West along West line of said Southwest quarter of the
Northwest quarter, 347.56 feet; thence South 88*57'43" East 780 feet; thence
North 3*13'7" East 211.62 feet; thence North 77*9'34" West 151.59 feet; thence
North 3*13'7" East 100 feet to a point on the North line of said Southwest
quarter of the Northwest quarter. which bears North 88*31'5" West 500 feet
from the West margin of Sidney Road; thence North 88*31'5" West along the
North line of said Southwest quarter of the Northwest quarter, 630.15 feet to
the true point of beginning; EXCEPT the West 40 feet thereof conveyed to the
City of Port Orchard for street purposed by deed recorded under Auditors File
No. 947178.
PASSED by the City Council of the City of Port Orchard, signed by
the Mayor and attested by the Clerk in authentication of such passage this 9th
day of August, 1993.

A. Rezone - "RH" to "ME-20"
H. Special Use Permit - Retirement Apartments
On June 20, 1977 the City Planning Commission held a public hearing on both
a Rezone application and a Special Use Permit as submitted by Mr. Donald
Ostrom, Owner (Ridgemont Terrace Nursing and Convalescent Care Center).
The site contains an area of approximately 5.90 acres and is located at the
south end of Pottery Avenue, across from the Cedar Heights Jr. High School;
address is 2051 Pottery Avenue.
The public hearing on said applications were held in the following order:
A. The Planning Commission passed a motion to recommend that the City
Council approve the application for rezone from "Residential High"
Lo."Multiple Family - 20" based on the following FINDINGS and subject
to the following CONDITIONS.
FINDINGS
1. The proposed increase in density falls within the scooe of the
City's Comprehensive Urban Development Plan.
2. The proposed development does not fall within the defined boundries
of the following Land Use documents as adopted by the City Council.
a. Flood Prone Areas.
b. Comprehensive Parks, Recreation and Open Space Plan. -
c. Shoreline Management Master Program.
3. The proposed increase in density to 20 dwelling units per acre
complies with the guidelines as stated in the City Zoning Ordinance
No. A99, whereas:

"Multiple Family - 20 dwelling units per acre district establishes
high density multiple residential development area in urban
locations where established public services (police & fire) and
facilities (water & sewer) are available".
4. That the proposed use is not in conflict with existing land uses
in the vicinity of the proposed development.
5. "EVALUATION AND DECLARATION OF ENVIRONMENSTAL SIGNIFICANCE" review
by Les Knobbs, City Engineer - J. L. Snow, Fire Marshal/Building
Inspecter and Al Mares, Police Chief notes a negative declaration.
CONDITIONS
1. Construction is subject to the plot plan and architectural design
as submitted as part of this rezone application.
2. That the surface drainage from the site shall not exceed the present
rate of flow.
B. The Planning Commission also (in conjunction with item "A" above) passed
a motion to recommend that the City Council approve a Special Use Permit
which would permit a retirement home type apartments, having special
features to accomodate the disabled in conjunction with the existing
Nursing Home facilities. The proposed complex would consist of a twenty
(20) dwelling (apartment) units in a single structure.
Approval by the Commission was recommended based on the following FINDINGS
and subject to the following CONDITIONS:
FINDINGS
1. The proposed use is permitted in the MF-20 Zoning District subject
to a Special Use Permit.
2. That the proposed use will not conflict with existing uses now located
within the vicinity of the proposed project.
3. The site complies with the basic requirements called for in the City
Zoning Ordinance No. 899; "where established public services and
facilities are available".

CONDITIONS
1. That construction be in accordance with the plot plan and architectural
design as submitted as part of this Special Use Permit Application.
2. That the off-street parking be allowed to be reduced by 50,10 of the
regular required parking because of the proposed character of the
project.
3. That the future (proposed) additional 20 unit structure to be located
at the rear of the property not be approved as part of this application.
