AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1469; BY
AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING
CERTAIN PROPERTY (Joni and David Randall, owners of
record) LOCATED 1561 RETSIL ROAD.
WHEREAS, Joni and David Randall, owners of record, have petitioned
a zoning ordinance amendment, requesting reclassification of property located
1561 Retsil Road, and
WHEREAS, The City of Port Orchard Planning Commission has transmitted
to the Council of the City of Port Orchard, Washington a copy of their Resolution
No. 204-93 - ATTACHMENT "A" recommending approval of said petition, and
WHEREAS, The Council of the City of Port Orchard did hold a Public
Hearing on December 13, 1993 to hear testimony of fact and conclusion as follows:
FINDINGS OF FACT: The use requested is compatible with
other uses in area.
The proposed use is a permitted use within Commercial
General.
CONCLUSION: Based on testimony, materials presented and
findings of fact, the Port Orchard City Council does
hereby conclude that granting this zone reclassification
would not be detrimental to the health, safety, morals
and general welfare of the community.
NOW, THEREFORE, be it ordained that the Council of the City of Port
Orchard, Washington does hereby adopt Planning Commission Resolution No. 204-93
with Findings of Facts, as their own and does hereby reclassify certain property
from Residential Low to Commercial General allowing conversion of a residence
into a beauty salon, with the following conditions:
1. Coverage, including buildings, parking areas, driveways, and
walkways, shall occupy no more than seventy percent (70%) of the
total lot area.
2. A minimum of two parking spaces will be provided on site.
3. A lighting plan shall be submitted and approved prior to placement
of outdoor illumination and shall be oriented away from neighboring
residences.
4. Signage shall be in compliance with the adopted Uniform Sign Code
and must be approved by the City prior to implementation.

5. A building permit shall be obtained prior to the beginning of any
construction or demolition work on site.
6. All parking stalls shall be striped and marked including handicap
parking. Concrete wheel stops, at a minimum, may be used to define
parking stalls.
7. All new landscaping shall be maintained and any dead or diseased
landscaping within one year of occupancy shall be replaced.
LEGAL DESCRIPTION: Section 25, Township 24, Range 1E, beginning at
the South 1/4 corner of section S 88*24'24" East 738.03 feet North 0*21'30" West
129.11 feet South 89*42'30" East 10 feet to point of beginning North 0*20'30"
West 80 feet South 89*42'30" East 150 feet South 0*20'30" East 80 feet North
89*42'30" West 150 feet to beginning except the Westerly 30 feet for road
together with that portion of vacated County Road Number 349 known as Retsil Road
as recorded in Com. Journal 15 on Page 486, situate in Kitsap County, Washington.
PASSED by the City Council of the City of Port Orchard, APPROVED by
the Mayor and attested by the Clerk in authentication of such passage this 27th
day of December, 1993.

RECOMMENDING THE CITY COUNCIL APPROVE A LAND USE
RECLASSIFICATION FROM RESIDENTIAL LOW TO COMMERCIAL GENERAL
FOR THE PROPERTY LOCATED AT 1561 RETSIL ROAD AS REQUESTED BY
JONI AND DAVID RANDALL OF HAIR AND ALL THAT JAZZ.
LEGAL DESCRIPTION:
Section 25 Township 24 Range 1E, beginning at the South 1/4 corner
of Section S 88024'24" East 738.03 feet North 0021130" West 129.11
feet South 89042130" East 10 feet to point of beginning North
0020130" West 80 feet South 89042130" East 150 feet South 0020130"
East 80 feet North 89042/30" West 150 feet to beginning except the
Westerly 30 feet for Road together with that portion of Vacated
County Road Number 349 known as Retsil Road as recorded in Com.
Journal 15 on Page 486, situate in Kitsap County, Washington.
WHEREAS, the applicants requested a land use reclassification
from Residential Low to Commercial General to convert a residence
into a beauty salon, and
WHEREAS, a public hearing was held on 15 November 1993 and the
Planning Commission considered the facts of the proposal,
testimony, and materials presented at the hearing, and
WHEREAS, the Planning Commission finds the proposal is in the
furtherance of health, safety, morals, and general welfare of the
community.
WE THEREFORE FIND: that the proposed land use reclassification
from Residential Low to Commercial General is compatible with
surrounding land uses and will not have a detrimental effect on
adjacent properties.
CONCLUSION: Based on the facts, testimony, and materials
presented at the hearing, we therefore conclude that the
reclassification from Residential Low to Commercial General is in
harmony with the general purposes and intent of the Zoning
Ordinance and the Comprehensive Plan.
BE IT RESOLVED, that the Planning Commission of the City of
Port Orchard hereby respectfully requests the City Council approve
a land use designation of Commercial General for the above
described property.
