AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON AMENDING PORT ORCHARD ZONING
ORDINANCE NO. 1469; BY AMENDING THE AREA AND
USE MAPS THEREOF, RECLASSIFYING CERTAIN
PROPERTY (City of Port Orchard, owner of
record) LOCATED AT 200 TREMONT STREET.
WHEREAS, City of Port Orchard, owner of record, has
petitioned a zoning ordinance amendment, requesting reclassification
of property located at 200 Tremont.
WHEREAS, The City of Port Orchard Planning Commission has
transmitted to the Council of the City of Port Orchard, Washington a
copy of their Resolution No. 177-91 - ATTACHMENT "A" recommending
approval of said petition, and
WHEREAS, The Council of the City of Port Orchard did hold
a Public Hearing on January 27, 1992 to hear testimony of fact and
conclusion as follows:
FINDINGS OF FACT: The use requested is
compatible with other uses in area.
The proposed use is a permitted use within
Residential High Zoning.
CONCLUSION: Based on testimony, materials
presented and findings of fact, the Port Orchard
City Council does hereby conclude that granting
this zone reclassification would not be
detrimental to the health, safety, morals and
general welfare of the community.
NOW, THEREFORE, be it ordained that the Council of the
City of Port Orchard, Washington does hereby adopt Findings of Facts
as their own and does hereby reclassify certain property from Green
Belt to Residential High to construct a fire station, with the
following conditions: 1) A landscape plan shall be submitted
identifying type, location and size of planting materials; 2) A
lighting plan shall be submitted and approved prior to placement of
outdoor illumination; 3) Landscaping found dead or diseased within
one year of planting will be replaced; 4) The private access road
and building parking area shall be paved with asphalt; 5) A minimum
six foot fence shall be constructed per City standards; 6) The
stormwater detention pond shall be constructed per City standards;
7) All parking stalls shall be striped and marked including
handicapped areas; 8) Planting materials shall be installed prior
to building occupancy.

RESOLUTION NO. 177-91
A RESOLUTION BY THE CITY OF PORT ORCHARD PLANNING COMMISSION
RECOMMENDING THE CITY COUNCIL APPROVE A LAND USE
RECLASSIFICATION FROM GREEN BELT TO RESIDENTIAL HIGH FOR
PROPERTY LOCATED IN THE VICINITY OF 200 TREMONT STREET, AS
REQUESTED BY THE CITY OF PORT ORCHARD.
LEGAL DESCRIPTION:
Section 35, Township 24 North, Range 1 East, Kitsap County:
Parcel four of Short plat 1033, Recorded October 5, 1984 under
Auditors File Number 8410050134, Records of Kitsap County,
Washington; except the northern most 120 feet.
WHEREAS, the City of Port Orchard requested a land use
reclassification from Green Belt to Residential High for purposes
of constructing a fire station, and
WHEREAS, a public hearing was held on Monday, 30 December,
1991, and the planning commission considered the facts of the
proposal, testimony, and materials presented at the hearing, and
WHEREAS, a SEPA checklist has been submitted and received a
Declaration of Nonsignificance, and
WHEREAS, the proposed use of the property is in harmony with
the provisions of the comprehensive plan, and
WHEREAS, approval is based upon the following conditions:
1. A landscape plan shall be submitted identifying type, location
and size of planting materials.
2. A lighting plan shall be submitted and approved prior to
placement of outdoor illumination.
3. Landscaping found dead or diseased within one year of planting
will be replaced.
4. The private access road and building parking area shall be
paved with asphalt.
5. A minimum six foot fence shall be constructed per City
standards.

WE THEREFORE FIND: that the proposed land use reclassification
to Residential High is compatible with surrounding land uses and
will not have a detrimental effect on adjacent properties.
CONCLUSION, based on the facts, testimony, and materials
presented at the hearing, we therefore conclude that the
reclassification from Green Belt to Residential High is in harmony
with the general purposes of the zoning ordinance and surrounding
comprehensive plan designations.
BE IT RESOLVED, 'that the Planning Commission of the City of
Port Orchard hereby respectfully requests that the City Council
approve a land use designation of Residential High for the above
described property.
