HomeMy WebLinkAbout1539 - Ordinance - Zone Classification for Property Located Within the Vine Street AnnexationORDINANCE NO. 1539 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASH INGTON ESTABLISHING INTERIM LAND USE DESIGNATIONS AND DIRECTING THE PORT ORCHARD PLANNING COMMISSION TO INITIATE PROCEEDINGS TO ESTABLISH COMPREHENSIVE PLAN DESIGNATION AND ZONE CLASSIFICATION FOR PROPERTY LOCATED WITHIN THE VINE STREET CORPORATION ANNEXATION WHEREAS, the City Council did on October 28, 1991 hold public hearings and subsequently adopted Ordinance No. 1528 (effective November 11, 1991) approving annexation of territory commonly known as the Vine Street Corporation Annexation into the City of Port Orchard, and WHEREAS, the City Council is required to establish Comprehensive Plan designation(s) and zoning classification(s) for property within the incorporated city limits NOW, THEREFORE, the City Council of the City of Port Orchard does hereby ordain as follows: SECTION 1. THAT Interim Land Use Comprehensive Plan Designation(s) and Zone Classification(s) be adopted for properties lying within the area commonly known as the Vine Street Corporation Annexation (Legal description - Exhibit "A") and does establish the interim Comprehensive Plan Designation(s) and Zone Classification(s) to be the closest comparable designation(s) and classification(s) as what was established by the former jurisdiction along with any conditions, limitations, or restrictions applied by the former jurisdiction as though they were part of this ordinance. SECTION 2. THAT the Port Orchard Planning Commission shall commence the public hearing process to establish Comprehensive Plan Designation(s) and Zone Classification(s) for the Vine Street Corporation Annexation area. WEATHERILL, MAYOR 611 ack 1-1*1 1.101112 3va City Attorney Councilman Morrison Ordinance No. 1539 Exhibit "A" DESCRIPTION That portion of the Southeast quarter and Southwest quarter of Section 25, Township 24 North, Range 1 East, W.M., and of the Southwest quarter of Section 30, Township 24 North, Range 2 East, W.M., and of the Northwest quarter of Section 31, Township 24 North, Range 2 East, W.M., and of the Northeast quarter and the Northwest quarter of Section 36, Township 24 North, Range 1 East, W.M., all in Kitsap County, Washington described as follows: BEGINNING at the Northwest corner of the Southeast quarter of Section 25, Township 24 North, Range,1 East, W.M., in Kitsap County, Washington; thence in an Easterly direction along. the Northerly limit of said Southeast quarter of said Section to a point on the Easterly right of way margin of SE Olney Avenue ( County Road 328); thence in a Southerly direction along said Easterly right of way margin to its intersection with the Northerly right of way margin of Hortsman Road (County Road No. 41);thence in an Easterly and Southeasterly direction along said Northerly right of way margin to its intersection with the North line of the plat of Navy Yard Addition to Sidney as recorded in volume 1 of Plats, page 87 records of the Auditor of Kitsap County, Washington; thence in a Westerly direction along the North line of said plat of Navy Yard Addition to the Northwest corner of said plat; thence in a Southerly direction along the West line of said plat to the Southwest corner of said plat; thence continuing in a Southerly direction along a line being the Southerly prolongation of said West line of said plat to its intersection with the Southerly right of way margin of State Route 160; thence in a Westerly direction along said Southerly right of way margin to its intersection with a line being the Southerly prolongation of the Easterly right of way margin of Retsil Road; thence in a Northerly and Northwesterly direction along said Easterly right of way margin ( and said Southerly prolongation thereof) to a point on the South line of the Northwest quarter of the Southeast quarter of Section 25, Township 24 North, Range 1 East, W.M.; thence in a Westerly direction along said South line to the Southwest corner of said Northwest quarter of the Southeast quarter, said point being the Southeast corner of Lot 2 Fowler's Replat as recorded in volume 2 of Plats, page 84, records of the Auditor of Kitsap County, Washington; thence continuing in a Westerly direction along the South line of said Lot 2 to the Southeast corner of the West half of said Lot 2; thence in a Northerly direction along the Easterly limit of said West half of said Lot 2 to a point on a line, being the Easterly prolongation of the center of Dekalb Street; thence in a Westerly direction along said Easterly prolongation to the Easterly limit of Dekalb Street; thence in a Northerly direction along said Easterly limit 30.00 feet; thence in a Easterly direction along the Northerly limit of vacated Dekalb Street to the West line of the Northwest quarter of the Southeast quarter of Section 25, Township 24 North, Range 1 East, W.M.; thence in a Northerly direction along said West line to the Northwest corner of said subdivision and the point of BEGINNING.
